After cooldude255220 has done so much work on this, it would be churlish not to give it a try.

I've done it as the nominated person on behalf of my wife (In case anyone is wondering, I was not the driver either). I'm hoping my Dr title might signal that I won't roll over and will go all the way to court, and it will cost them.

Or more than likely, as the arrogant shysters they appear to be, they will ignore the inference, and as they rake in so much from this racket, they probably don't mind losing a few quid here and there.

They limit the appeal text box to 1000 words, so I've put in the opening paragraph and then added the appeal in full plus all the appendices.

“Please note that I am appealing on behalf of Mrs XXXXXX who was not the driver of vehicle registration XXXXXX at the time of the alleged infringement referred to in Parking Notice SPXXXXXX and has no obligation legal or otherwise to inform Smart Parking Ltd of the driver of vehicle registration XXXXXX. Mrs XXXXXX is the registered keeper of vehicle registration XXXXXX and appeals as follows: Please see Doc 1 appeal for full wording of the appeal, as it is greater than the 1000-word limit designated by this text box.”

It will be interesting to see the rejection letter

IAS HAS UPHELD MY APPEAL.😁

It’s not April Fool's Day, nor am I delusional (at least I hope not); this is genuine, as per the attachments.

Why have they bucked the trend and done the right thing?

I can only guess they decided that if someone was knowledgeable and professional enough to put this appeal together at this stage, then there was no chance whatsoever of wringing money from them, and that pursuing it further would be a lost cause that might result in substantial costs for Smart Parking Ltd.

Or maybe they just throw out a random few to make it seem they have a reasonable appeal success rate.

But whatever the reason, I am extremely grateful to cooldude255220 for the time and effort he’s put into this, and I hope that this success is not an aberration but signals that we might have a fighting chance against these shysters.

Once again, thanks to all of you for helping me through this.

Well done on your win, although technically, the PPC conceded before the IAS ruled on your appeal.

I'm going to go against the grain and advise that you do appeal to the IAS, for these reasons:

1. According to the latest figures, ~ 25% of appeals are conceded by the operator. May as well see if you're in that lucky quarter. 
2. If you're not that lucky, there's teeny tiny chance the IAS might actually allow the appeal. 
3. Win or lose, you've still cost the Operator a bit of money because they have to pay for every adjudicated decision. 
4. I want to see if there's any reasoning with the IAS, so I've put together a special IAS appeal to try and head off some of their nonsense, but it needs a Guinea Pig to test it. Dropbox link here to the appeal, customised for your circumstances, and appendices. You'd just need to fill in the PCN number.

@The_miser_2: As @Castle said, the Operator withdrew before adjudication, which makes you one of the lucky 25%.

But I do hope this shows that there is value in appealing to the IAS, for that reason, if nothing else!

I do wonder if the operator is advised to withdraw by IAS, as they have already rejected the appeal and are well aware that, in most cases, they do not have rightful grounds to do so.

A nod from the adjicator to the operator;

Not a chance with this one, withdraw.

50 - 50 on this, but there is a chance we might allow it, or else we will look like bigger (insert your own word here) than we already do.

This person hasn't a clue, go for it.

Does anyone know the cost difference if they withdraw?
