Can online grocery sites change the price of items after being checked out?
Recently Sainsbury’s have changed (increased) the prices of some items after I have placed them in my basket and checked out. I have noticed this happening for the last couple of orders but it’s possible it has been happening for longer.
The first time I queried it with Sainsbury’s they claimed that the items were limited time Nectar offers. They state that there should have been a message pop up the screen to warn about the cut off date for the offer, but I don’t recall seeing any messages.
It happened again with my latest order, but this time the items weren’t on offer. Two items had increased in price AFTER I had placed the order and checked out. I received a confirmation email after checking out which showed the lower price but the next time I went to the Sainsbury’s site the price of my basket had changed.
I have contacted Sainsbury’s to ask if this is an error or if it is policy to change prices after checkout. I am currently waiting for a reply.
Is it legal for Sainsbury’s to change prices like this?

If so, up until when does the system allow you to amend the contents of the shop?

Yes, online grocery orders for home delivery.
The order can be amended until 11pm the night before delivery.
The contract question is the one I want answering, is the contract created at the point of online checkout, or when a member of staff puts the items through the physical checkout, which is when payment is taken.

Answered in their terms:
2.1 The prices shown on this Website at the time of ordering are guide prices. The prices you will be charged for goods will be the actual prices displayed in the store at which your goods are selected on the day of delivery, including any promotional offers if applicable. You accept that prices of goods may, therefore, increase or decrease between the day of ordering and the day of delivery.

Yes they can change the prices but you make an offer when you place an order, they can accept, decline or counter offer.
Changing the price is a counter offer, I think it should be brought to your attention, I’m sure they send a final invoice/receipt but to my mind they should be specifically drawing your attention to any changes to allow you to decline their counter offer should you wish to.In the game of chess you can never let your adversary see your pieces1 -

The items are not charged till they scan & checkout them just before delivery. You do not pay for the goods till the day of delivery, not when you place the order.
You checking out of the app/website is not, more often than not is not the price you will pay. Due to items not being in stock or a alternative being given.

Essentially, Sainsbury’s are offering a picking and delivery service for you, and you get the prices valid when that happens. I don’t think that’s inherently bad, but other companies such as ocado do offer a fixed price service.
Surely, what matters is the overall value and quality of the goods delivered?

I think the issue is you can get a bit stuck, ordered a 900ml bottle of washing up liquid for £3.50 from Morrisons, out of stock on delivery, substituted with a 600ml bottle of the same brand for £3.
If I need the washing up liquid, I don’t want to pay that much but it would cost more to go to the shop.In the game of chess you can never let your adversary see your pieces0 -

With Waitrose you can reject any substitutions and they refund the money. With ocado substitutions never seem to happen.
