Smart Parking BPA or IPC?

Good evening, just a quick thread about a PCN I have recieved, im currently on the 14 day of issue, and tempting to pay the £60 for the driver, as cant be dealing with the ping pong of letters and emails, been here before!

But something has caught my attention, the driver was issued a PCN for non payment at a local social club, along with other people who genuinely didnt know they had to pay.

They have proof that they paid for drinks using their card, and the club owner had contacted one of the drivers to say they will try and get the charge removed, but could take up to 3 weeks.

I've just seen a picture of the Smart Parking sign at the Club, pretty dark to see at night. The sign says that Smart Parking are members of BPA? Is this still correct or is this signage wrong?

Is this worth appealing considering the information above? Sign also states patrons only, which there are a number of drivers in the same situation

Would that be grounds for appeal, along with the other points raised?

Yes it's worth exposing that sign at IAS stage - only because it is embarrassing for them and Smart might not contest it.

Not because IAS is a fair appeals service! Barring a brain fart from a drunk Assessor, everyone expects to lose at IAS because it's a kamgaroo court, but nobody pays.

Thanks, I think ill appeal it, and mention it to others who are in the same position. If I appeal, is the initial £60 held, or does it revert back to the £100

It doesn't matter. You'll never pay, so it isn't relevant at all.

That sign is also suggesting "Regulations" apply they don't and private parking companies are not regulated. That sign to me infers statutory authority rather than a commercial contract.

Hi again, just a question as I'm just writing up the online appeal

The date of the contravention is 27/03/2026

The charge was issued 10/04/2024

Is this technically withing the 14 day? Ie weekends etc

If so, where can I find the template for NTK if that applies

Nope, had to be delivered within 14 days from the incident date to invoke Pofa2012, where the incident date is day zero

Issued 14 days later, presumed delivered 2 business days later, on the14th, so beyond the deadline

Study any non Pofa2012 appeal in previous cases , mentioning no keeper liability due to the failing to comply with Pofa2012 , there used to be hundreds of these appeals back in 2024 or earlier ( Smart Parking, NCP, Britannia Group Nexus etc ) , such as
