She has viewed the flat twice, her brother lives in the same block so she knows the apartments well. She has had her operation and can travel but she keeps putting back her travel dates with no reason.

Unfortunately there is no redress as until we exchange there is no legal contract between us.

As her brother lives in the same block as you why don’t you speak with him, explain your concerns and ask him if he knows the buyer’s intentions? At the very least he is likely to speak with his sister and it might speed up the process or at least speed up the decision.

Unfortunately we don't know him. She has asked for a further viewing at the end of May before she will exchange / complete but we've asked if her brother can undertake this for her.

Well, which one is correct? If 2, then immediately put the flat back on the market. And why haven't you been in touch with her brother as he may well be a useful go-between.

Number 2.

We dont know the brother. There's a lot of people in the block and we don't actually live there.

1. Tell her you will be putting on the market from [say] 1st May if she hasn't exchanged by then. She can get a representative to view or fly over in that time.
2. Then once its back up on the advertising portals, tell her if she gets back in touch and is ready to exchange before you find another buyer then you'll sell to her, but if not you can't keep waiting.

That way if another buyer takes longer than May you still have the chance of this buyer, but you've started the ball rolling on readvertising in case she's just wasting time.

Thanks - yes this is our approach now - we've said her brother can view on her behalf and are setting a deadline of the end of April for exchange.
