    In the unlikely event of a court hearing remember you can bring other people with you such as another leaseholder as a witness, plus a McKenzie friend.

    Not usually recommended, but you could also just have it heard on the papers if needs must.

    At the end of the day the situation is no different from a neighbour putting a sign up in THEIR garden stating that you must display permission to use YOUR garden and if you fail to you must pay THEM £100.

    It really is that ridiculous.

  • Latest update: Our specific property manager is on leave (extremely conveniently) until the day the scheme was meant to come into place. We had no response for days, leading to a flurry of emails and calls from residents and leaseholders that forced Pinnacle to reply saying we’d get a response from the regional manager once she returned from leave on the 5th.

    She and Pinnacle have sent out correspondence today to say the scheme will be on hold until after our property manager is back from leave when he can respond to our questions and concerns. Feels like they are just fobbing us off, but we’ve bought some time so I will be fascinated to see his response.

    My guess is the management/Pinnacle have already signed the contract with the PPC and will now and impose the scheme regardless, using terms like Industry standard, regulated by the BPA/ipc and so on

    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"

    What is the next step if that is the case, considering they’ve done that unlawfully?

    No, I suggest either:

    • club together for a solicitor to apply for an emergency injunction (as per the case of Roger Davey v UKPC) and get those costs back from Pinnacle, or
    • Ask for the entire scheme to be frozen for the time being and cover up the signs with black bin bags and seek ADR, citing the Duchess of Bedford House landmark case to scare Pinnacle re costly litigation.
