Euro Parking Services - Parking Charge Notice

Firstly I apologise for creating a new thread about this, however I have a question regarding the newbies' thread advice: According to the Newbies thread my first action should be to call the retail company and complain about the fact that I've received a parking charge notice demanding £60.00 for parking in one of their bays for 1 minute and 55 seconds. My concern is if I call them would I not be admitting myself as the driver? Also I am creating this thread to make sure I have done the template correctly, I would be grateful if a good soul here could review my template appeal response before I send it off….

My other concern is that the template states: "You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle." - they have taken photos of the vehicle and on the ground it says "customer parking only", I only parked there for 1 minute and 55 seconds because I ran across the road to give something to my friend who lives there, there was nowhere else to park as there was roadworks on the main road where my friend lives. I didnt read the wording on the ground when I parked as I was in a rush, it was only when I got back to the car that I saw it.

Anyway I plan to go straight to appeal using the following template:

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.


If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    That picture is a Notice to Keeper, so you are complaining as Keeper, no need to mention who was driving

    The pcn is actually £100, reduced to £60 for early payment

    he Royal WE may suffice

    Read the Joint Code of Practice regarding consideration period, to park or leave

    Complaining never means saying who was driving! Of course not.

    Say "we" are disgusted because the driver saw no prominent signs at all.

    Unfortunately the retail manager was having none of it, saying he needs to see proof of purchase someting was bought at the store, even if the person just came in to browse it seems, for a parking period of 1 minute and 55 seconds I find it ridiculous, surely there's a grace period of even 5 minutes, anyway looks like ill have to just appeal using the template, thanks guys! Will post back whatever happens.

    Don't use the template, at least remove the PDT machine bit, of course!

    Were you meant to use a keypad in the store? One minute isn't a fair consideration period.

    Appeal unsuccessful, I used the original template (my bad), all did was nip across the road to drop something off to a friend, I’m annoyed and stressed… anyone know what I should do now? Can’t believe they didn’t even mention anything about the grace period, surely 1 minute and 55 seconds is harsh, you should get atleast 5 minutes.

    I doubt there’s any keypad in store, the manager said it’s for people who park there and then walk across the road to other places other than coming into the shop, even for less than 2 minutes apparently.

    Although they have footage, is it possible to argue in court that the driver was likely planning on going into the store after visiting his friend over the street but upon seeing the ludicrous fuel prices felt quite put-off from doing so, changed his mind and instead decided to leave?

    Also, shouldn’t they have specific details of the £100 penalty displayed more clearly? They have a large sign which reads “parking terms apply” and then a smaller sign with tiny writing which mentions the £100 penalty. If the driver had known there would be a £100 fine then surely he’d have avoided the place altogether, just feels I’ve been snared, I’d 110% rather it go to court than pay anything beforehand.

    You can argue whatever you want in a court hearing , but a judge would decide who is right based on the paperwork and evidence brought to the court, plus landmark rulings by higher courts

    There is no penalty, just a £100 parking company charge ( invoice. ) for any breach of the parking contract on that private property

    Signage plays a crucial role in these court cases, as does landowner authority, so they are crucial to any case
