Billing Finance - ‘Not us guv!’
Hi, I’ve put claims in for 5 accounts with both Billing Finance (2 of) and CF247 (3 of).
CF247 have so far not responded, but Billing Finance advised they cannot find one of the agreements and the other one they hold no details for because it’s more than 6 years old and therefore the details have been deleted due to GDPR. Is this right and is there any way around it?
Thanks in advance.

Businesses deleting old data (or archiving linked to an agreement number) is perfectly correct, if they have no records then you should supply them from your own archives or see what the FCA recommend if the company knows they had DCA but don't have your details
Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

Companies generally have a right to delete documents after 6 years (although certain regulated sectors may have their own rules too) - although GDPR does not strictly say they have to do that after 6 years.
But, if they have done so, and you don't have any paperwork, then its your word against theres and you're unlikely to get anywhere.

From recollection the FCA have said that they recognise companies may have deleted data but if claimants can provide details themselves then they should look at those details.
So question for OP is do you have details about the loan that they are saying they can't find.

Fortunately I do have all the documentation, it was where I got the agreement numbers from. Will the agreements and various paperwork like that be considered sufficient by the finance companies?

Have you provided that paperwork to the finance company?

Not yet, I received a separate email today from Billing regarding an ongoing investigation into the same account which would suggest they sent one email or the other by mistake. Going to sit down with the laptop tomorrow and dig out every last document from my agreements and collate them.

Remember that we are in the changeover period from complaints to the redress scheme. So, things will be handled differently between the two.
