    This is an appeal by the registered keeper - No driver details will be given. Please do not bother with your known fishing expedition in an attempt to get driver details to try and get around the fact there is no keeper liability (and never can be under POFA).

    Due to this being airport land you will be well aware there is no keeper liability due to the byelaws in force and the fact this is not relevant land.

    As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @POPLA . Please therefore cancel the notice or issue a POPLA code where you will auto withdraw

    If you waste your time asking for driver details this will be ignored and you will still lose at POPLA if you dont cancel the PCN

    So let's save my time and yours and cancel this PCN you simply cannot win this (and you know it).

    I am the registered keeper of the vehicle and I am appealing in that capacity.
    I will not be identifying the driver, and I am under no obligation to do so.
    I do not accept any keeper liability for this charge. The alleged contravention
    took place at Gatwick Airport, which is land governed by airport byelaws. As
    such, it does not fall within the definition of "relevant land" under paragraph
    3(1) (c) of Schedule 4 to the Protection of Freedoms Act 2012. The keeper
    liability provisions of POFA therefore do not apply, and liability cannot
    transfer from the driver to me as keeper

    On that basis, there is no lawful route by which Times24 UK Limited can hold me
    liable for this charge as keeper. I would therefore ask that the Parking Charge
    Notice be cancelled.

    If the charge is not cancelled, please issue an IAS appeal reference so that
    the matter can be considered independently. I would also be grateful if you
    could confirm that the 14-day discounted rate of £60 will remain available to
    me in the event that this appeal is rejected, in line with the IPC Code of
    Practice

  • Hello amazing people, i received a fine recently and appealed via their online portal with the following text yesterday and they replied today to cancel the fine. I used the following text and I'm so grateful for this forum as I wouldn't have challenged had people not posted helpful tips like this so THANK YOU.

    TEXT USED IN APPEAL"

    I am the registered keeper of the vehicle and I am appealing this Parking Charge Notice in that capacity.

    I note that your notice states that the driver is liable for the charge. I will not be identifying the driver, and I am under no obligation to do so.

    The location in question is Gatwick Airport, which is subject to statutory control by way of airport byelaws. As such, the land does not fall within the definition of “relevant land” under Schedule 4 of the Protection of Freedoms Act 2012, specifically paragraph 3(1)(c).

    Accordingly, the provisions of Schedule 4 relating to keeper liability do not apply in this case. In the absence of any lawful basis to transfer liability from the driver to the registered keeper, I cannot be held liable for this charge.

    In light of the above, I request that the Parking Charge Notice be cancelled.

    If you do not agree, please provide the necessary details to enable me to refer the matter to the Independent Appeals Service (IAS). I also request confirmation that the discounted amount of £60 will be held for the duration of the appeals process in accordance with the IPC Code of Practice.

    If the car is a leased car, suppose the above wording would NOT be relavent as the leasing company has already named the leasee and for instance Times Parking would already have the leasee's address, thought it's still possible to not name the driver.

    It would just need tweaking (hirer/lessee instead of the word 'keeper') or just copy & use the Edna_Basher appeal at the end of the first post of the NEWBIES thread.

    No PPC complies with para 13/14 of Schedule 4 so there is no hirer liability.
