Are we not doing SAR for parking firms anymore?

Hello

I think there was a section regarding a SAR on the newbies thread but I cant find any mention of a SAR presently. Should I do it now? later? or never?

I have done an acknowledgement of service today within the 14 day period.

    No, sometimes its better not to know, plausible deniability , besides which a SAR reply is more likely to arrive after the defence deadline anyway, so why bother. ?

    Besides, I would probably email a SAR a month or two before the WS deadline date, if necessary , not the defence stage

    You should concentrate on what needs doing, in the correct order, leaving a SAR for a future stage

    I am planning to argue in my Defence that no evidence of parking was provided by the claimant. (They have those cameras at site entrance). I work as a private hire driver so I will claim that the evidence proves i entered and exited the site at those time stamps but that I was never parked.

    is this reasonable as a defence?

    i will still use all other points on the defence template.

    Cannot really comment until you reveal more details, so firstly I suggest that you post properly redacted picture of the claim form below after hiding the personal and private information, as seen in other recent cases on here, leaving the dates showing etc

    The AOS deadline is 19 days after the issue date, not 14 days

    What does the POC on the claim form state? That is what you are defending against.

    You need to defend against unauthorised parking! What were the circumstances of the event? What is the date of issue of the claim form?

    I actually have 2 claims for the same site same offence different days with the same issue date.

    If they are a firm which alleges 'keeper liability' under the POFA 2012 (which they don't have to!) the a postal PCN must arrive by day 14 if there was no windscreen ticket.

    I am pretty sure the first letters with the NTK were not sent within the time frame they should have. I kept the original envelope but even though it has some codes I am guessing for sorting by post office don't really know how to prove it was not delivered to me because I remember the date inside the notice being the 14th day after the contravention but the letter was sent to me more than a month after.

    It is for DBC LEGAL known for running the cases all the way to 3 days before trial then dropping so I guess they are just trying their luck.

    I entered and exited their site in 2 separate occasions during the same day. But they are claiming it was only one extended stay. they took the first event entry stamp and used the second event exit stamp. I sometimes used their site as a place to have a bite in the car while waiting for the next fare.

    They should have issued one money claim for all outstanding invoices, not 2 separate claims

    You defend against the allegations in the POC itself, against the alleged breach, if pleaded

    2 short stays regarded as one long stay is known as double dipping, meaning their allegations are false ( its a very well known error with ANPR cameras. )

    It matters not a jot that this was a double dip or that you never parked, they are claiming you were on site without authorisation in effect there was no offer to park anyway you were trespassing.

    They cannot send you an invoice for trespass, a contract needs an offer, an acceptance and a consideration, they offered you nothing they can charge for.
