Multiple PCN’s

New to the forum.
I’ll try to cut the story short as much as possible.
Recently I have received 2 letters off BW LEGAL stating I owe £1020 in PCN charges ( 6 x fines )
here’s some back story - I moved into my current apartment last May … I pay an extra £100pm for my allocated parking bay, when I first moved in I was told off the estate agent that my parking permit would be with me within the next week or so … as you can guess permit never arrived and I totally forgot about it due to my busy day to day schedule… fast forward a year and I receive this two letters off BW LEGAL who are working on behalf of UK CAR MANAGEMENT LTD … turns out I have 6 pcn charges for having no permit for using the bay I pay for and is allocated to me and my registration.
Firstly I don’t think I’m at fault here, as I was waiting on the permit being delivered. And even so I have paid in full to use that parking space, regardless of what a piece of paper says.
Anyway I have filed a complaint for each pcn (x6) via the uk car management website which takes up to 10-28 days to be reviewed ( classed as an appeal I believe )
and I have phoned BW LEGAL and forwarded proof that I have complained to the client (UK CAR) to which they have put a small hold on the debt until I hear back.
Also I would like to point out that not once did they ever stick a note on my car to at least let me know so that I could of dealt with it much sooner or even send me photographic evidence ( apparently sent it to my old address ) to which I have requested and is on its way to me.
But hand on heart I don’t think the fault is mine here … end of the day that bay is paid for in full.
No doubt they will decline my appeal and will most likely end up paying this money … it’s an absolute farce and nothing more than daylight robbery!
Any help and advice would be much appreciated on this matter

I'm no expert on this but we had to fight a couple of PCNS at our flat some years back. What we did was find the tenancy leasehold agreement - you get it when you buy or move in - did it say we needed a permit to park on our own space - nope. Then we wrote back to the company and said we disputed the payments because of a) paying extra for parking bay and only using same and b) copy of tenancy agreement enclosed showing no permit as per lease. But they said the signs said to have a permit. So we wrote to the management company with copy to the PCN enforcer to say we had applied to have one, it never came so what were we to do. We also asked management company to tell them to cancel the PCNs We kept all copies of correspondence, never spoke with them (as no record) and eventually they gave up. sample of letter we used…. dispute the debt in full. The vehicle was parked in my own allocated bay, which I pay for under my tenancy. The permit was never provided after I moved in. Please place the matter on hold while your client obtains instructions from the managing agent / landowner and provides copies of all notices, photographs, and evidence of contractual authority. The lease and tenancy are two different things.
Find out what the lease says. The property might grant rights over the space meaning the parking company cannot enter into a contract with whoever uses the space.
Get it off your landlord or another owner-occuper in the development.2 -

I would be complaining (Plan A in the NEWBIE sticky) to the estate agent and making them sort this out and informing them that if you end up having to pay (after case has been to court) you will be expecting them to reimburse you in full.

I tried this … they say it’s my fault for not chasing up the permit with them once it didn’t arrive … in a way I get it but I was just busy with life and work etc … the fact that my name, reg are allocated to that specific bay .. a tiny piece of paper shouldn’t make any difference!
And only residents with car parking allocation receive an electronic fob to open the gate for entry.
No one else can gain access. It’s a money grabbing trap.

The fact that you have a fob should be used in your defence as it makes you de facto authorised to park there. I don't think I would be accepting the fob-off (no pun intended) from the estate agent as they are abdicating their responsibility and putting the onus on you - keep at them! Ask them for the name of who will be will attending the court hearing (if it comes to it) as you will be calling them as a witness.

That's utter tripe and a fob off, if you told them, you told them, why should you be held responsible for their incompetency.
You do not have any "fines" they are speculative invoices from a scamming parking company that give their services free so that they can skim cash out of people that fall in to their traps. Does the worthless piece of paper come from the parking company? If it does there's the very reason you never got it typical scam they engineer.

so basicially when I moved in may 25 - they emailed me saying the permit has been sent to me and if it doesn’t arrive to let them know … not long after this I got locked out of my email account and had to create a new one … I thought that my car being allocated to that specific bay I would be okay without it .. so never chased it up. And the fact I never had any tickets stuck to my car it would be okay - it’s only now a year later that these 2 letters have come through stating I owe money 1 letter says £170 and the second saying £850 ( total of 6 PCNs )
The thing is these letters arnt off the parking company they have have passed the debt onto debt collectors ( BW LEGAL ) and this is where I’m currently at - if my complaints to the parking company get rejected not sure what to do next.
This is just ridiculous and a pathetic way to claw more money off hard working citizens.
As if like isn’t hard enough … could do without this rubbish.
