PCN Received from Euro Parking Services Ltd

I was parked for 1 minute and 40 seconds on a small private industrial estate road but open to the public. There were signs by Euro Parking Services Ltd. saying if you park, stop or wait you will be fined £100.

Their traffic street warden took images of my car parked on an area absent of double yellow lines, but elsewhere there were faded, difficult to see or missing double yellow lines.

Their own images show me parked where there are no yellow lines.

I appealed stating I had a sudden medical emergency and had to stop very briefly to adjust a lumbar support which was causing great pain. A couple weeks earlier I had fallen and went to A&E with broken ribs. I sent them proof of visiting A&E and a follow up visit with my own doctor, but they said the dates do not correspond to the parking offence, which was two weeks after my injury.

They did not give me the option to appeal a third time to tell them the severe pain typically lasts for up to six weeks.

I am 70 and have a disabled badge in the car. They have ignored their obligations to a disabled person under the Equality Act 2010 and have also rejected my second appeal.

My only option now is to use there arbitration service which is know to be heavily biased in their favour.

They stated. If you are not satisfied with the outcome of your appeal, YOU CANNOT APPEAL

    Ignore them and wait for the Letter of Claim giving you 30 days notice or a Money Claim

    Dont bother with the IAS

    They definitely did not mention fines, just a parking charge, an invoice

    You can win your case if they issue a Money Claim in the future

    No double red lines there, so that IS NOT a no-stopping zone.

    It's a completely unmarked kerb with someone lurking.

    An entrapment zone. Got you in one minute. No chance you read the signs of agreed to a contract.

    This is scammery and it is truly embarrassing that the MHCLG thinks the IPC and BPA can be trusted to carry on agreeing 'no stopping zones' because this isn't one. It isn't marked correctly with double red lines, has no 'repeater' signs facing traffic and isn't there for safety reasons!

    You are certainly not going to pay that invoice!

    Their treatment of you has been appalling, quite apart from the fakery of a no stopping zone and zero consideration period:

    Hmmm what do the regulars think about putting this one to the IAS, based on:

    • no double red lines so it isn't a no-stopping zone. Unmarked kerbs are not no stopping zones;
    • No 'repeater signs' facing driving traffic. The image shows a sign at right angles to the road, with a metal fence & building behind which clearly isn't where the car stopped;
    • cannot have been agreed by the IPC because it's not a sensitive road nor a site with safety concerns;
    • zero consideration period and no hope of the driver seeing or agreeing to any terms in 1 minute flat while the disabled driver adjusted their lumbar support;
    • breach of whatever term in the appalling 'Joint Code' talks about brief hold ups for medical emergencies.

    Thank you for your recent correspondence regarding the above Parking Charge Notice (PCN).
    After reviewing the details of your appeal and the evidence held on file, we must advise that your appeal
    has been unsuccessful.


    The terms and conditions of use of the car park are clearly stated on the signs prominently displayed
    around the car park, these include vehicles are not permitted to park on restricted areas of the car park
    such as double yellow/red lines, crosshatched bays, no parking zones. According to our records your
    vehicle was incorrectly parked, we have no option but to reject this appeal.


    Following a review of the PCN evidence, the vehicle was observed parked in a restricted zone.
    Note, the stopping or standing of a vehicle whether occupied or not is classed as parking.
    We checked your evidence; your evidence date does not match the contravention date.


    The discounted payment of £60 remains available for 14 days from the date of this letter. If payment is
    not received within this period, the full amount of £100 will become due.

    If I use IAS and they reject my appeal, I will have to pay the full £100. If I still refuse to pay, what will happen. Do they send a bailiff or do they have to take me to court.

    If IAS reject your appeal then it makes no difference. They aren’t binding on you

    Don’t pay the £100.

    No bailiff will be sent.

    If they decide to go down the court route then just follow the steps outlined in the “Newbies” thread. It’s highly unlikely that you’ll ever have to pay anything for what is basically a scam
