    Just an update on the current claim. The claimant called to try to settle by proposing that I pay them £200 which I refused. I have now received notice of proposed allocation for the small claims track form to complete and send to the court. Any advice going forward? Thanks

    Yep, stop talking to them, ignore them, follow the 8 steps in the defence template thread

    Then follow the what happens next advice in the newbies sticky thread in announcements near the top of the forum by coupon mad, studying post 2 carefully

    They were insisting that because the 28 day period for the driver details has passed I remain responsible for the claim. Thanks

    Well, they would say that wouldn't they. ?, but if you had a lawyer they may say different , ask 10 and you might get 10 different opposing answers, sameas you see in criminal cases with both counsels painting a different picture

    There are 2 important factors here

    1. Its down to the referee ( judge in court. ) to decide the outcome, if dcb legal pay for a hearing
    2. DCB LEGAL always discontinue ECP single pcn claims, plus they fail to pay the hearing fee, so you will never get a referee decision because the match will be abandoned just before more money has to be paid

    Study the following thread and comments, especially from a lawyer ( johnersh. ) about the transfer of liability at any time up until a court claim is issued
