ECP AND DCB Claim for parking fine

    I have used the template for my defence, but added this for paragraph 3:

    The vehicle is recognised and it is confirmed that the
    Defendant was the registered keeper and not the driver. The 
    details of the driver was emailed to the claimant on the 10th of 
    March using the email info@dcbl.co.uk at 10:58am and yet received 
    a money claim form with no response to the email.

    Do I need to add anything else or not??

    Do what coupon mad suggested earlier, adapt paragraph 3 in the defence template, but use all 10 paragraphs in the MCOL defence box

    I hope that you have logged into MCOL via your government gateway account and completed the AOS online stage to get more time. ?

    yes i have already done that. I am just trying to submit my defence through the MCOL. I have used all 10 paragraphs as the template and added above statement as paragraph 3. I have also added the initial contact after the 28 day deadline to provide driver details which was declined by claimant.

    The year needs adding to the date

    Remove the first sentence above, and instead add but not the driver to the end of your paragraph 2, where it should be

    Paragraph 3 should refute the POC shown on the claim form

    Here is the amended paragragh 3 below.

    3.0 The defendant therefore refutes the claim by the claimant

    3.1. The details of the driver was emailed to the claimant on the
    10th of March 2026 using the email info@dcbl.co.uk at 10:58am and 
    yet received a money claim form with no response to the email.
    The email also made provision for evidence of travel as well as
    car insurances covering the said car as well as own personal
    car confirming that there are two cars in the household with the
    said car not driven by defendant and challenging the claimant to check
    their CCTV.

    3.2. The claimant was also contacted in the initial stages when defendant
    received the letter to give them the details of the driver but was
    informed to wait and go through the process because the deadline
    for driver details has passed.

    You realise they lied? There is no such deadline in the applicable law: POFA Schedule 4.

    You need to call this lie out as 'misleading conduct' (which is illegal under the CPUTRs) and state the date that you provided the full name and address of the driver. If that was given to DCB Group prior to litigation, then Schedule 4 says that keeper liability no longer exists.

    With an issue date of 24/03/26 and having completed the AoS in a timely manner your defence deadline date is 4.00 p.m. on 27/04/26
