Car finance reclaim for someone who has died.

I have used the reclaim tool very successfully, and found quite a few agreements on the "my equifax" app.

My question is for a friend whose husband had quite a few cars on finance in his name, but sadly passed away in 2015. How can she find any agreements in his name? Does she sign up with myequifax with his details?

    That is potentially a very quick way to be flagged as a fraudster if she tries to impersonate a deceased person. Banks etc should have informed the CRA that they are deceased and so it'd be very easy to spot.

    The FCA is still consulting on the redress scheme but most signs point to it being the lender that will have to proactively reach out to those who compensation is due to so if thats how the scheme ends up being they won't need to do anything, assuming they havent moved since his passing.

    As I understand it, a claim for redress can only be made by the administrator/executor of a deceased person's estate. No other party can make a valid claim unless they were named on the original finance agreement.

  • Thanks. She is the executor of her husband's estate. The problem is finding the agreements

    As the executor they could try and submit a SAR for all the data held but likely it will have been deleted 6 years after they were closed particularly as they died in 2015
