C4 form eik needed

Really need help. I need to send back and eik to the court as my dad is now wanting to sell my late mothers house. I never added her share of the property onto the original confirmation because I did not know the value and my dad still livedthere. Now he wants to sell because im dealing with mums estate I need to get an eik done. I now know how much the value was when she died and now what her share is worth I have the figures to enter on page 4 and the description as he has sent me a letter from his lawyer. Im not in any financial position to pay the fee and ive been.told once I add this value it wil still fall under 50000 im struggling to fill in the form and wish to do this eik myself without legal help can anyone help me please ive been dealing with this for 3 years I want it over x thanks x

Is this the scenario?
- As executor, Confirmation was granted to you for your mother’s estate.
- The house was jointly owned by your mother and father (but with no survivorship clause in the title).
- You did not include your mother’s share of the house in the Confirmation inventory.
- You now need an eik to add the house share to the Confirmation to allow you to deal with the house share.
And who inherited your mother’s share of the house?

Buddy you are spot on all the above is correct I now need to do an eik to add my mums sgare as my dad wants to sell. My dad gets her share cause they were still married amd no will. Although my father knows mum wishes was for both me and my sister to get hers unless he gives up his rights he gets everything of hers unfortunately

No will so this is a Confirmation-dative. The fact that you were appointed executor-dative would suggest that prior rights did not exhaust the estate, because where prior rights exhaust the estate, then the surviving spouse is normally treated as having exclusive entitlement to be appointed executor.
Where prior rights do not exhaust the estate, then it is normal court procedure to require a Bond of Caution to be lodged with the Confirmation.
The bad news is that if a Bond of Caution was required with the original Confirmation application, then the court might require a Bond for the additional value of the eik.
I can advise on the completion of the C4(S) if you are going to complete. But I wonder if there is any scope for you to suggest that your father pays the costs involved.

Thanks for ur response I need to do this eik no matter what please can you help me with form ? I have attached pages im struggling with there is no decrease only increase and I dont know how to do the figure appreciate any help Thanks

You will find an example of page 3 completion here
Page 4 and 7 see example screenshots below on the 2021 form version (for deaths before 2022) - but you need to insert your own details.

As I dont have access to coloured . You have been amazing will need to look over these screen shots properly ty
