Moorside Legal claim form response

Hi everyone,

Thanks for all the invaluable advice on this forum - it's been very helpful to me many times.

I've been fighting an NCP ticket since June and am now at the stage where I've recieved a Claim Form from Moorside Legal.

I'm following all the guidance I can find here but my only question is this - my particulars of claim state a specific breach, unlike previous forms I've seen from Moorside. Does that mean I reply as usual but omitting the paragraph about Chan & Akande?

Correct, an overstay or insufficient payment, so not the Chan and Akande defence paragraph, so standard template, denying the POC

You are not replying, you are defending, using MCOL

What is the date of issue of the claim form? If you post that date we can give you some deadlines for AOS and defence.

I've been abroad since the beginning of the month and returned last night (18.3.26) to find this claim form letter. Unfortunately I thinks this means I missed the 14+5 day window by one day. I did submit an AOS straightaway yesterday and checked that no judgement has been submitted yet. I'm preparing the defence now ready to send over. Unfortunate timing but I'm hoping I've done what I can.

Getting the AOS in late is absolutely fine and freezes the case. You can now defend.
