Capita Data Breach/Barings

I’ve just had an email from (Removed by Forum Team), Head of Data Breach at Barings Law advising that he is moving to Abbleys Solicitors and taking the Capital Data Breach case with him. Has anyone else received this? Wondering what the implications of this are? Thanks

    Your contract will be with Barings, so if they are continuing to act they will remain your legal advisers on the case. If they are exiting the case, then there is usually an amicable agreement that allows you to end your contract with them and sign a new one with the firm taking over.

    You should not enter into a new contract without knowing what is happening on the existing one.

    Barings’ own and third‑party news pieces in Feb–Mar 2026 describe the Capita group action as “brought by Barings Law” and talk about “our claimants” and “our case”, which strongly implies they remain on the record for at least thousands of claimants. None of those updates mentions Barings withdrawing from the claim or handing it over wholesale to another firm. That said, it is entirely possible there is an internal or client‑specific arrangement under which a particular lawyer (and some clients who sign new documents) moves across, while Barings continues to act for the rest.

    I have received the same email today. I would have expected Barings to contact me first. My last email from Barings on 9 Feb was from a (Removed by Forum Team). My initial reaction is that this is someone who has left Barings chancing their luck, or, as dunstonh comments, (Removed by Forum Team) has permission to contact a limited number of people by agreement with Barings as party of a mutually agreed employment transfer. I will await his promised follow up mail, then contact the last Barings representative to communicate, (Removed by Forum Team) to see what the official Barings position is.

    My concern is they are asking us to sign a new contract….

    Please rest assured, Barings Law has agreed that I may continue to act for you following my move to Abbleys Solicitors. At present, Barings Law does not have the capacity to handle matters of this nature, and it is very important to us that your case continues to be progressed and concluded as quickly as possible.’

    As your case will be transferring to Abbleys Solicitors, you will shortly receive a welcome email from Abbleys Solicitors with a Contingent Fee Agreement for you to sign so they can commence acting for you.

    But given that Barings are the one who initiated the case, I find it hard to believe they don’t have the capacity to handle the claim themselves.

    Hoping there’s more clarity released from Barings…

    This is quite common when a specialist lawyer moves firms and is the main fee earner handling a particular case or type of case.


    However, to reassure yourself that everything is above board, I would contact Barings direct, to get confirmation from them (preferably in writing) that they are indeed happy for Mr Malik to take the cases (and clients) with him to Abbleys - the last thing you want is to be caught in the middle of a dispute between two firms.
