Hi all,

I have followed all advice thus far on the forum including all the legal stages. I have now submitted the witness statement promptly. It wasn't the usual 14 days before the hearing deadline. So I've submitted before the date given but I have not received WS from the claimant at all.

Is there anything I need to tell the Judge regarding WS from claimant should the hearing go ahead?

TCP do tend to continue to hearings so expect to receive their WS soon.

Then you can go through it and make yourself a crib sheet for the hearing.

what if they've not delivered the WS on time to me. does that make any difference? DCBLegal are calling me everyday so settle i assume.

If it gets to a hearing, raise the lack of WS as a preliminary matter, breach of the court order

Hi all,

Little update - DCBLegal have emailed back saying the content (PDF) you have sent is not opening. They've asked me to send one in another format.

I have checked, and the format is opening on everything but their computer. SEEMS VERY SUSPICIOUS!

Weirdly enough, I've still not received anything from their end and it's well past the deadline now.

Try saving it as a pdf in WORD, by publishing it as a pdf document

Then Zip the pdf as well

Attach both to your reply, stating that its in the correct format and not password protected

Also ask them why they haven't sent you their WS or an N279 discontinuation document by email

And threaten them with costs if they don't confirm discontinuance within 48 hours.

Update -

DCBLegal have come saying we have not received any orders and to provide them with the court order/letter of transfer of proceeding to the court.

Either they are playing dumb or are shambles

Morning all,

I've still not received any witness statement or notice of discontinuation despite my email.

Think it will just go ahead as usual unless they pull a late discontinuation.
