transfer of inherited property

Hallo, My dad died in December and left his flat to me and my 2 siblings. It's worth about £140k. We intend to sell it. We just got probate so I have looked into notifying the Land Registry of the need to change ownership to us as beneficiaries which I assume is a pre-requisite to being able to sell it.

I have already done all the IHT 400 and probate forms myself so thought this part should be straightforward (presumably a very common situation!).

It seems we need to fill in AS1 and AP1 forms.

So AS1 is ok, although a bit of a faff to get witnesses to our 3 signatures as we all live in different parts of the UK but ok. But Form AP1 - not at all clear what is needed so all comments welcomed:

  1. It looks like we all need to provide certified copies of our ID. By certified, is this from a notary? Can we self-certify? can it be from a professional eg teacher, like on passport applications? It's not clear on the guidance forms
  2. It's not clear if we need to provide evidence of address as well as ID (ie do we need to provide utility bills etc as well as passports)

The guidance on fees is also not clear but I have seen other comments on the forum about different schedules applicable so I will look into this.

Do most people just use their conveyancer to sort this part out? I am surprised there is not more helpful advice available on the gov website (it refers you back to the section for professional conveyancers) given it's pretty useful for most other aspects around bereavement.

Anyway, thanks for any helpful comments - and if you have negative comments, please don't reply 😀 (as I have seen on some other posts) - most people here are dealing with death of loved relatives and a lot of bureaucracy and don't need trolls on top. Thank you!

    You do not need to transfer the ownership if you are selling it can be directly transferred from the estate to the buyer.

    Which will save any issues with capital gains tax.

    Easiest way to get ID certified is to go to the post office with a copy of what's to be certified. Last I checked it was about £12? to get 3 documents done. They can be 3 different docs or 3 the same or whatever. So passport, driver's licence, whatever. Photocopy at the library if necessary, stomp over to the post office (check which ones doe this in each area) and then the certified copies can be posted to whomever is doing all the heavy lifting. Driver's licence is good because it's got the address as well.

    Sorry for your loss - there's always a lot of work to be done but I figure that keeps one busy at a time when you need a distraction.

    Re certification

    You, or close connected persons cannot self-certify.

    We had a number of documents that needed certifying for probate and I had a local Tax Accountant do the whole lot - I recall using the internet to search for "document certfication near me", but running the same query now just throws up a load of solicitors firms touting for business

    Sorry for your loss. We are in the process of selling a probate property and the conveyancing solicitor confirmed we do not need to transfer the property into beneficiaries names first. All we needed for selling was probate and EPC (energy performance certificate). I found a local guy who was registered for the EPC and much cheaper

    As others have posted if you are selling you rarely have to transfer (assent) it into your names before doing so. The buyer can rely on the probate.

    However if for any reason you do apply to update the register by way of a transfer/assent ……….

    Identity verification using the Post Office service is not applicable when it comes to identity verification for registration purposes. The forms you refer to (AP1/AS1 link to our PG 67 guidance on how to get your identities verified) -

    And the registration fee would be Scale 2 on the current market value of the property -
