Hi all, back again with another one!

As detailed in the template defence I believe DCB Legal/NexusGroup are stating breach within POC, so I just wanted to run through the response and whether this is adequate under current guidance:

Currently Point 2 continues:
The Defendant, has little knowledge of events considering this was more than a year ago, and has little to add other than admitting that they were the registered keeper and not driver, so questions whether the Notice to Keeper was even POFA compliant.

3. Referring to the POC: paragraph 1 is denied. The Defendant is not indebted to the Claimant. Paragraph 2 is denied. No PC was "issued on 03/08/2025" (the date of the alleged visit). Whilst the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The Defendant is not liable and has seen no evidence of a breach of prominent terms. The quantum is hugely exaggerated (no PC can be £120 on private land) and there were no damages incurred whatsoever. The Claimant is put to strict proof of all of their allegations.

That's an old argument. They don't get that wrong any more.

And are you SURE that DCB Legal have specified the breach? They don't usually, for Group Nexus claims.

Show us the POC & tell us the issue date.

Use the Chan and Akande defence template

The word ISSUED is not pleaded either ( the word Contravention is. )

Your defence refutes the POC, or should do

With an issue date of 24/02/26 and providing you complete(d) the AoS after 01/03/26 and before or on 15/03/26 your defence deadline date is 4.00 p.m. on 30/03/26

Hi all,

Looking for advice on witness statement. Left it late after being away and overlooking the statement date instead had in my mind the court hearing date.

I still have a "small' bit of time, it's due on the 3rd September!!! DCB legal haven't submitted their statement, and after checking on MCOL I can't see anything on there.

I've looked over some example witness statements but can't quite find all details yet that I need to include in the statement after leaving it late and am now getting a bit twitchy. I know I need to put my own point of view, but do I also need to add in the particulars of my defence, and also given that I have no statement from DCB Legal?

There is a good example written by @JackR1 for you to copy as an example of style and format. In the NEWBIE sticky post 2 there is a list of exhibits that you need to add to the WS. The court will have your defence; your WS backs up and supports, with evidence, what you wrote in your defence.

Chances are that DCB LEGAL have discontinued the case, so you should check your email inbox and spam folders for their N279 discontinuation document and post a redacted picture of it below

Phone the court ASAP to see if they actually paid the hearing fee, or has the hearing been vacated

The lack of a WS from DCB Legal is a red flag, so chase up the court ASAP
