We bought it at dixon's online. The delivery men said we could take the documents to currys and sort things out. Went to Curry's and they said we couldn't. We've not been able to get hold at anyone at Dixon's online who can help us and believe me we've tried. I, personally, would have told the delivery men to take it away but my mum was here when it was delivered.

I've quoted the sales of goods act in my email to them but am still waiting a reply. The dents etc are going to be replaced by an entire new top unit to the cooker. The faulty thermostat wasn't discovered until the cooker was attached to the gas / electritiy so we can't return it unless we pay for another gas guy to come and disconnect it. We are now dealing with Belling who seem to be excellent but I am still pursuing Dixon's for a partial refund.....actually, an apology would be good. Not sure we'll get either.

    Thanks for your advice.

I guess the problem is that they run their online busines "separately". In law, under SOGA, it's the same retailer. I view "online" simply as a different branch. It doesn't matter which "branch" you buy from. It's usually easier to go back to the branch where you bought, but it's not necessary under SOGA.

Keep quoting SOGA to them. Escalate if you get no joy. Unfortunately, it's very rare for retailers to actually train their customer service staff in SOGA. You often have to get "higher up the chain of command" to find someone who understands your rights - and their obligations.

    Keep it going ..... :D

Thanks Debt free chick....I won't be letting this one rest I can assure you. When I know something is wrong i'll fight all the way and enjoy it too! No point getting stressed when I can get even! I'm going to go and read up on SOGA.

At the end of the day Dixons only sell the things they can't repair anything & would have to pass it on to the manufacturer to get it repaired, that's if the manufacturer still makes that particular item.

Why should the OP have to deal with a 3rd party (samsung) They purchased it from Dixons, thats who there contract is with, so are quite rightly expecting Dixons to deal with the problem - the more parties that get involved the more potential for things to go wrong - do you really think that if there is a subsequent problem with the TV Dixons will not turn round and say "Samsungs problem now, not ours".

    I don't think they're doing that though.

Dixons are quite correctly dealing with the warranty in the way prescribed by the manufacturer, as they have every right to do.

Samsung wish to carry out their own repairs and they are entitled to do so. In passing your call to Samsung, Dixons ARE dealing with your claim for repair anyway.

You are NOT entitled under the SOGA to insist that the seller refunds or replaces the item.
