Another DCB Legal ECP claim - Overstay

Hi Everyone

I received a parking fine which I was unaware of as I had moved address and my registered address was a different address. When I changed the address I started to receive debt collectors letter. From the letter the reason I have received parking fine is because they claim I have overstayed in their car park when I went to visit a shop. However I did not overstay instead I went to buy something form B&M and then went again later the day. Unfortunately I paid by cash and have not kept the receipt as did not know I had a claim against me.

Unfortunately due to circumstances described above I could not appeal and I also contacted B&M who stated over the phone they cannot do anything about this and to ring parking compony.

I ignored the debt collectors letter but now have received small claim court issued 19th Feb and need urgent advice what's best thing to do and how I would make my case strong. I don't have the evidence what euro car parks limited have so kind of stuck.

    2. appeal to the landowner - if B&M say they can't help - ask them who the landowner is.
    3. Which car park? Which PPC?
    4. Post a redacted copy of the small claim letter
    5. this is NOT a fine

    With an issue date of 19/02/26 and providing you complete(d) the AoS after 24/02/26 and before or on 10/03/26 your defence deadline date is 4.00 p.m. on 24/03/26

    Use the relevant words (suited to the PPC and solicitor) from the template defence thread.

    Your picture is incorrectly redacted, your password and VRM are on show, so replace it

    Standard ECP , DCB LEGAL, claim form, issue date 19th February, for an alleged overstay

    Do what Le_Kirk mentioned, use the standard template defence

    It will be the retail park management company hat hired ECP, not B&M

    • do you know how I can find who the owner of the land is?
    • Can I also check if I need to do subject access request as I entered the car park twice - the intention was never to overstay and have not abused the usage of their car park
    • Do I need to also get a picture of the signage for the case?
    • Do I need anything else for defence?

    No need for a SAR yet

    Definitely Get pictures of the signage

    Study the 2nd post in the newbies sticky thread in announcements near the top of the forum

    Thanks all - I have been trying to review what happen on the day and initially I thought it may be double dip but when I looked at bank statement I saw I had actually paid by card on the day and also it was a football match so you can only stay for an hour and may have been in the shop slightly longer and there was a que to come out on the day due to football match which may mean I was in car park for more than an hour.

    I contacted B&M who said go back to car park compony. I am bit stuck in terms of what to do and also stuck in terms of defence as I do not have full information.

    Login to MCOL via your government gateway account and complete the AOS online stage ASAP

    Then

    Use the defence template in announcements near the top of the forum by coupon mad

    Use the paragraph 3 in the link below and adapt it to suit your own case
