    I read and re read everything a million times but it didn’t make sense theres too many links and too many abbreviations lol

    But I get it now

    I’m at the scare stage theres a chance they take me to court or maybe they might not. As I haven’t received any court documents which could take months/years I need to wait for that and see what description is give in the claim.

    Both my PCN have been forwarded to Gladstones so hopefully if they’re vague enough it should be an open and shut case

    Also, I had a chance to read the clauses for BPA and IPC and I had a valid reason for remaining in car park in their appeals charter it mentions medical emergency as valid excuse
    so if they do decide to persue I can say they’re unreasonable and have wasted my time causing unnecessary stress and inconvenience by not following industry protocol.

    And for the second PCN I wasn’t the driver but in the evidence pack they have breached POFA 2012 by not stating that if the driver is not disclosed the registered keeper will be held liable for the penalty.

    Let me know if my understanding is correct

    I’ll probably keep this thread open until I do recieve court letters

    I am going to work on a drafted version anyway will tweak it depending on how incident is described in N1 form

    Pofa2012 is not mandatory, so any breach would indicate that the driver could be liable, but no keeper liability, especially if the keeper was not the driver, as in the 2nd pcn

    There is no penalty ( or fine ), just 2 invoices ( PCN's. )

    Gladstones Solicitors cases are usually flawed because no actual breach is mentioned , hence why the defence is a bespoke version

    The initial letters come from the CNBC in Northampton, not from a court !
