2026 - DCB LEGAL, ECP court claim, defended
Hello,
I have received a LOC from DCBL regarding an overstay in a retailer car park a few years ago.
I have referred to the NEWBIES thread and sent the below as a response per the instructions:
Dear Sirs,
Your ref: [insert reference number]
Proposed legal proceedings
Claimant: [insert name of parking company]
I refer to your letter of claim.
I confirm that my address for service for the time being is as follows, and any older address must be erased from your records:
[Insert correct address here]
You should revert to your client because the 'propensity to pay' score in my case is zero, so any claim is hopeless and a waste of the court fee (whether 'fronted' by your firm or not). Move on to weaker victims.
The alleged 'debt' is disputed and any court proceedings will be vigorously defended.
Yours faithfully,
I received the following response:
We write to acknowledge safe receipt of your formal response to our Letter of Claim sent to you in respect of this matter.
Having considered your response, our position in respect of this matter remains as per our Letter of Claim. We note that despite your points of dispute, there is an absence of any evidence in support of the same so that we may consider this with our Client. If you do have evidence which you believe supports your dispute, please furnish us with the same within the 30 days afforded to you.
As it stands, the initial 30 day timeframe under the Pre-Action Protocol remains, and County Court proceedings will be issued following expiry of this 30 day period, without any further reference to you.
We strongly recommend that you contact a member of our dispute resolution team on 0203 838 7038, as a matter of urgency so we may discuss this matter with you and avoid a Claim being issued against you.
What do I need to do now? Is there another response I can send to the LOC? Or do I now wait for a claim form to send the defence template? I can not seem to find anything on the NEWBIES thread that outlines this in-between stage.

There are no steps in this in between stage.

I have now received the Claim Form. Do I complete the paper form and not write anything on the defence?
I am slightly confused. I thought this was all online, where is the template for the defence? Do I print this and post it with the Claim Form?0 -
You do not complete any of the paper forms. It is all on-line, just log on to your Government Gateway account using the reference and password in the N1SDT form. What is the date of issue of the claim form? Follow the template defence in the announcements. If you can, scan or photograph the form to show us the POC.

Don't post the whole template (we don't need to check @Coupon-mad's work) just the end to your paragraph #2 and your paragraph #3.

I was just going to leave paragraph #2 as it is. For paragraph #3 I don't know what to put. The claim is from 2023 for allegedly overstaying on a supermarket car park where I cannot confirm or deny if I was the driver?
