…which is the incorrect information.
As user1977 says, knowing there is a (potential) issue with building control signoff doesn't preclude getting indemnity insurance and fraud doesn't come in to it in relation to knowing or not that such an issue might exist. It is the (recently) talking to the council part which is problematic.

It was poorly worded I agree… I had meant (but didnt say), if you know now it doesnt have regs because you phoned up the council and asked them then you can't buy indemnity because you spoke to the council. Your absolutely right that if the vendor admits there was no sign off and you dont contact the council then yes you can still buy the insurance.
