Sadly airline will take the stance that the travel agent was acting on your behalf.
In terms of chargeback, airline T/C would play no part in that. It would be a simple case of seats cancelled by party. As such there is no chargeback right.

But in terms of the overall booking, the cancellation by the agent was them acting on your behalf and that cancellation of the flight is being treated the same no matter if it is a travel agent acting on your behalf or you doing it directly. The agent booked the flight on your behalf, so it is treated as them cancelling on your behalf.
As others have suggested you could file a claim against the travel agent, but it might be better to discuss with ATOL.

Do we seriously think that as the flight has been cancelled the seats are not going to be resold but that the airline will not resell them but fly out empty?

But any such opinions about the ultimate fate of those seats aren't relevant to OP's rights here, unless there was a case to be made under the relevant jurisdiction that the airline's Ts & Cs are void by virtue of being unfair.

how can you have booked seats when you do not have tickets for the flight?
The seats will be booked as normal by anyone who buys a ticket for the flight. Just the same as the seats were allocated on the flight when the tickets were bought.The OP didn’t buy the seats- the agent bought them with the flight ticket. You can’t. Book a flight with no seats. They are part of the flight booking.
The seats were cancelled by the agent when the flight was cancelled.

Money was paid to Travel Agent and they booked and paid for the flights. The flights where then issued to me, I then applied pre booked seats to them.
Holiday was booked 04/07/2025
Seats booked 10/07/2025
Found out all had been cancelled 25/11/2025
I understand the concept of a flight ticket actually being a seat on the plane and the Travel Agent has effectively cancelled this seat, but they do not come with free pre selection and the the pre booked seat selection is passed off by the airline as a "product"

The agent has the authority to act on your behalf. You and the agent in the eyes of the airline are one and the same. That's what an agent is.

The entire order can be accessed and altered by either yourself or your agent. You are both one and the same.
