ECP Fine and Debt Collection Appeal Rejection
Comments

That's fine. It won't stop it yet but it'll be sorted by the Winter, when they discontinue the claim (the claim form will come next) …
…but why not go more on the attack?
Surely you saw the news last week and the threads here talking about the CMA now investigating ECP?
Read it ALL including the CMA's issues with ECP and the Open Letter that this consumer protection regulator sent to the wider parking industry.
"the correspondence for this infraction has been going to an old address that we were in the process of moving out around the time of parking. I have only just been given the letters in relation to the fine in the last couple of weeks and the debt recovery agency now say that my appeal window has passed."It hasn't. They just lie.
Read the Joint Code of Practice section about reissuing PCNs and pausing debt recovery, where it is discovered that a PCN was not served due to it going to an old address.
Now add to your LBC reply some really robust paragraphs quoting that clause and attaching proof of when you moved, and say ECP will see your evidence sent to the CMA if they keep refusing to deal with you and reissue the PCN. As it was a major keying error they must offer to settle for £20.
Send the same shirty words to both, laying it on thick about their lack of good faith and Code breach (and REALLY push the CMA threat) then see what rubbish DCB Legal and ECP come back with…
… THEN send everything to the CMA telling them that ECP have refused to deal with you and reissue the PCN and pause debt recovery (as required in the CoP) despite having evidence you had moved around that time and despite the fact that DVLA KADOE rules state that the parking firm remains the data controller at all times, and as such, operators cannot just say "talk to the debt collectors, it's nothing to do with us".
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
