ECP Fine and Debt Collection Appeal Rejection

I parked in an ECP in Manchester in September, I used an app to pay but unfortunately had an old Vehicle Reg stored, I have the screenshots of this parking session in the app and the money leaving my acount to ECP. I was parked in the space withing the paid for 4 hours.

Unfortunately, the correspondence for this infraction has been going to an old address that we were in the process of moving out around the time of parking. I have only just been given the letters in relation to the fine in the last couple of weeks and the debt recovery agency now say that my appeal window has passed.

What options are still available to me to be able to have this fine reduced or dismissed or do I just now have to wait to attend court?

    It’s not a fine. It’s an invoice

The “Newbies” thread is your friend.

Have you notified ECP DPO of your new address you don't to miss a court claim by it going to your old address. See NEWBIES Post 4 Debt letters scroll down to Changed address?

Also change V5C and driving licence with DVLA.

  • Thanks for the above advice, I took some further information from the Newbies thread and sent correspondence to both DRP and ECP but have either failed to respond to, or in DRP's case inform me that I am now outside of the timeline of the appeals process.

Would anyone know how I obtain the 10 digit verification number necessary to launch a POPLA?

No chance of getting a popla code, that ship sailed a long time ago !

    Ignore them for now

Come back to this thread if you receive a Letter of Claim or a Money Claim

You wont be attending any court

  • These are the only responses I've had since contacting them after being passed the correspondence that had been going to an old address.

Hello again, I have today received my first ever correspondence to our new address. So, good to know at least that any important documents or information won't now be missed.

I just wanted to clarify that there is still nothing to do at this point as this is a new debt collection company to the ones that had attempted to contact me previously.

That letter is shown in pictures in post 4 of the NEWBIES thread and we never need to see them.

Hi again all, I have today received my Letter of Claim from DCBLegal and I have drafted the below using the template from the newbies thread, I have added a paragraph briefly explaining the dispute as well as suggested, feel free to let me know if this is worth adding or not.

Also, is there any other email than the suggested info@ for DCBLegal or is that the only option?

    "To whom it may concern,

    Your ref:

    Proposed legal proceedings

    Claimant: Euro Car Parks Limited

I refer to your letter of claim.

I confirm that my address for service for the time being is as follows, and any older address must be erased from your records:

You should revert to your client because the 'propensity to pay' score in my case is zero, so any claim is hopeless and a waste of the court fee (whether 'fronted' by your firm or not). Move on to weaker victims.

The alleged 'debt' is disputed and any court proceedings will be vigorously defended.

This dispute is, as has been previously communicated to your client, that the parking was fully paid for at the time of the alleged infringement but under the registration of a vehicle I previously owned that was among the saved details in the app for payment. Your client incurred no financial loss for my parking.

    Yours sincerely,"

Thanks again all for your help, apologies if this is going over old ground, I would just like to have this sorted now as my wife is getting a bit stressed with me not just paying it.
