    If the OP is confident that the phone has not been damaged post-purchase then this seems a bit defeatist.

    No, he thinks SBE have spent 30 seconds eyeballing the thing and thought "here's another easy £250".

    No evidence to suggest otherwise.

    Well, it is not clear. The OP says "the complaint would fail if SBE provide evidence of physical damage" and then "they probably have this information".

    So, is the OP admitting that there likely was some physical damage but will still try to get away with a claim regardless, possibly under durability if that was a pocket press or slam shut of the phone which the OP considers "normal use"?

    In a past life I worked with a company who sent a lot of repairs to SBE - I handled the handsets going to them and their reports were usually pretty spot on.

    If a handset was physically damaged they'd reject the repair, but 99% of the customers wouldn't argue as they knew fine they'd damaged it themselves and it was fair enough.

    If SBE have a report stating physical damage, that'll likely be enough for a court to side with the retailer IMO.

    Did you read the OP's post that I quoted?

    He suspects that SBE will "… have photos or evidence of it being caused by physical damage…"

    Why would he say that if he was confident that it wasn't caused by physical damage?
