I often wonder what the point of this sort of thread is, where the OP asks for help and then basically tells everyone they're wrong and why they're wrong to every response they apparently are seeking.

They havnt, they just said it's physical damage, nothing else no evidence provided

As in going Consumer rights route anyway, it's Currys/Car phone Warehouse I'm dealing with, as Consumer Rights Act doesn't really apply to Motorola

More reading online suggests Motorola are way harder to deal with since merging with Lenovo.
Anyway, it's Currys/Pc World I'm trying my luck with

If you're confident of your interpretation of the CRA then you should pay to open a small claim against Currys and make your case, but if they judge disagrees with you then you'll know that the knowledgeable people on here who have warned you that you could be wrong were in fact correct.
I'd say it's fortunate that it's not Motorola you have to deal with (even though it won't be a picnic with Currys) as I had to do a chargeback in order to get a refund for a returned item which they had promised to pay but never did.
