Reclaiming flight cost back from credit card
Hi all
Apologies if this is not the right section of the forum, but I am seeking some advice please.
I booked a flight for a group of friends through myTrip. After booking, one of the passenger noted they use their middle name as their day to day name and I had booked the ticket in this name, rather than the true name on the passport, i.e. the first name on the ticket was actually his middle name (I did not know this about him). The flight was on a Friday and I reported this to myTrip the Thursday in the week before, so 8 days before travelling. I sent myTrip a copy of his passport on the Friday in the week before, as requested and they said they would amend the ticket.
Despite speaking with myTrip almost every day following, they had not changed the ticket and my friend was not able to fly as was refused at the check-in. MyTrip would not provide a refund.
MyTrip said they could change the ticket but did not. Furthermore, when I spoke with the airline, they said they had received no request from myTrip to make the amendment.
My question is, whether there a claim that can be made through the credit card company for non delivery of services?
Thanks for any input.

No, you are the one who has made the mistake by booking it in the wrong name.

Your gripe is with MyTrip, however proving they failed in their attempt to change the name and getting recompense will be difficult.
Who exactly did you talk to at the airline and when?
Have you got a recording of the conversation where they deny MyTrip contacted them?
Getting redress from your credit card is unlikely as the flight was available for Mr Wrongname Whoever.0 -
I spoke with various people at the airline helpdesk on the Tuesday and Thursday before the flight, but did not make a recording.

Notwithstanding the above posts, it looks like you booked your tickets with 'mytrip' who were acting as an agent for the airline, rather than booking the trip direct with the airline concerned?
This breaks the direct debtor (customer), creditor (lender) and supplier(retailer) chain and would not be covered under S75. Scroll down the following MSE link for an explanation:
Then there is the problem of you booking for friends – I assume they paid you for the airline tickets? See the above link for the ‘grey area’ of ‘purchased something in the name of someone other than the primary cardholder’.
I really think your best hope might be some form of customer service gesture from myTrip for their customer service failings, but this does follow from your own admitted mistake, so it really would be a gesture only.

Which airline was it and do you know if they allow name changes? - some will allow for a fee and many do not.
Never book international flights for other people without having their passport information - their passport may well be different to the name you know them buy. eg A friend got married 2 years after their passport was renewed, they chose not to waste 8 years of passport validity so need to book travel in their maiden name..someone booking for them would not know this and assume their passport was in their married name

If OP's claim relates to breach of contract by the agent rather than the ultimate supplier, then s75 should be viable.

Given OP booked via 3rd party, there would be no claim via chargeback or S75 for non receipt of flight.
Although it could depend on who exactly was paid. If it was direct to airline, then no. If the payment was to trip.com, then as above it might be possible. But another fly in the ointment is payment was not for OP or a direct family member & many CC would reject on that basis.
All they can do is talk to their bank & see how they react.
One reason to book direct to airline & each person books their own tickets.

Surely the significance of the unbroken debtor-creditor-supplier chain only relates to s75 rather than chargeback? There may well be other reasons why chargeback won't fly (sorry!) of course….

OP has not mentioned if they were charged for the name change or an administration fee for the correction. If paid and not done then I could see that the fee would be refundable as they paid for a service they did not receive.
If OP requested and paid for a ticket for Fred Smith and received a ticket for Fred Smith then they received what they ordered.

Yep you are correct on chargeback (my bad wording)
As it was in effect OP's fault they were not allowed on flight. Airline could reject chargeback.
As said really need to know who was paid.
