Fined for stopping outside the car park

Hi all, driver could use some advice on fighting this rather predatory company - BaySentry Solutions (IPC member).

The car park in question is Whitehall Riverside, Leeds.

The car park sits adjacent to a main road, and you must drive into Riverside Way in order to access the car park.

Upon approaching the car park, the driver notices that the car park is closed between 7am and 9:30am and a £100 fine is due if entering the car park.

Driver decides not to enter the car park, and stops on Riverside Way in order to find alternative parking arrangements. Total time stopped is 2 minutes and 15 seconds.

Unbeknownst to driver, there are signs present that say no stopping or waiting or a £100 fine is due. The driver is caught on camera stopping close to one of these signs, albeit behind the driver and not at eye level. The road has double yellow lines.

It seems you are damned if you do, or damned if you don't enter this car park between the hours of 7am and 9:30. The reviews on this car park online seem to be quite damning.

I have attached the notice with details retracted.

Any advice on whether or not this is worth contesting welcome.

Just to add - Riverside Way is a private road according to the Leeds street register.

Surely the driver has to stop to read the signs? The way that sign is positioned it would be dangerous to drive whilst reading it.

Well apart from all the usual arguments and advice in the newbies, I wonder what the other regulars on here think about a NTK from these idiots that actually uses the term " Event Type Illegal Parking" that is arguably a sanctionable term clearly displayed a number of times on the NTK?

And that you're right not to identify the driver, but it's not a 'fine'.

Start with step one in the newbies pinned thread and ask the landowner to cancel the PCN, then appeal as the keeper using the template also in the newbies thread.

But it is open to the public, I dont believe this fine is reasonable, don't name the driver, you are not obliged to pay. If in doubt, contact the local councillor.

The Keeper appeals it. Then the Keepe appeals at the IAS and finally, the Keeper easily defends it when they try top take them to court. Easy peasy win, as long as you keep your bottle.

The location is an entrapment. If you read there wording on the sign, unless it actually offers parking/stopping for the sum of £100, then there is no contract with the driver.

As already pointed out, the wording on the images "illegal parking" is not allowed. There is nothing "illegal" about this except the fact that this firm of scammers is suing PCNs unlawfully.

The Google reviews on BaySentry Solutions lead me to think they do not follow any due process and will simply escalate to debt collectors if I do not pay. Court looks like a likely option.

This isn't really something I have time for - not to mention it was a work trip and my client have offered to reimburse me for the fine.

At the same time, a big part of me hates to think these dreadful companies can get away with what is just a blatant scam.

Debt recovery firms are harmless
