Claim Form from DCBL

Firstly I apologise for creating a new thread on what is obvious a well discussed thread elsewhere.

I have read the newbies thread but just needed a bit more clarity on the situation as the RK has been in contact with Smart Parking. 

A PCN was received back in 2024 regarding insufficient paid time. The RK appealed stating that it was a keying error as it was a new vehicle, and that time was actually paid for. They didn’t receive a reply to the appeal. They got back in touch in May 2025 to clarify the situation regarding the initial appeal and I believe quoted the BPA CofP about appeals not answered within 56 days. Again there was no reply. 

A letter before claim arrived in October and they contacted Smart Parking to again clarify why it was still being pursued, and have had it confirmed by their Data Protection Officer via a Subject Access Request that no responses were made to the appeals by Smart Parking.

Now the claim form has arrived, they are wondering do they still need to do the necessary defence to all the particulars as stated in the thread, or as the RK has been in contact, will this change anything? Do they just clarify all I have said in paragraph 3 as their defence? They are a bit concerned as they are in ill health and will not be able to attend court if needed.

    No problem with you starting a new thread about own case. ! But DCBL  are not involved here 

    Its Smart Parking via DCB LEGAL  we assume. ?  (  not QDR. ?  )

    It wont even see a courtroom if they follow our advice here carefully 

    Post the Issue date from the top right of the claim form below 

    Post a redacted picture of the POC from the lower left side of the claim form below after hiding the VRM details first 

    No personal information at all

    The defendant completes the AOS online after day 5 following the issue date,  so day 6 onwards,  before day 19
    The defendant then uses the bespoke Smart Parking DCB Legal defence containing 11 paragraphs from the smart parking group thread by member sluzz, NOT the default 10 paragraphs version,  so not using that paragraph 3 at all

    Copy and paste into the defence box on MCOL,  save,  submit

    They aren't even writing a para 3 if this Claim os from DCB Legal (it definitely isn't DCB Ltd).

    Just use the Smart Parking Defence Group thread. The defence is specific and whilst they don't need to write a para 3 for a Smart claim, they could add this to the (specific to a Smart case) 11 paragraphs:

    The Defendant appealed and chased the dispute up more than once, but the Claimant failed to reply, putting them in breach of the industry Code of Practice and the DMCC Act 2024. A misleading omission of material information - in this case the lack of reply to appeal and withholding the required POPLA Code - 
    is a prohibited unfair commercial practice, which constitutes an offence.
