The fair trade Practice

I saw someone post earlier but it didn’t quite answer my question,I took out a contract with the fair trade practice two years ago regarding the possible claim for car finance,which I think still hasn’t been fully decided? However my husband logged his himself and it was super easy,the fair trade practice sent me a further letter last year to approve them to go ahead which I said I wasn’t signing and would like to cancel,they are now saying because of the work they have done there will be a cancellation fee,because I signed the original contract,they are saying black horse have been contacted and there is a fee to withdraw my claim,but nothing has yet been decided by the government right? ,the contract was two years ago,no one knows yet how much I could claim So can they charge me a cancellation fee? If so what would they be basing it on,so far it’s just a couple of emails?

  • You say you took a contract out with them - what does that say about cancellation?

    If they have done any work (including writing to Black Horse) then will have incurred costs that are chargeable if you cancel. After all, you wouldn't do work for free would you?

    The Government is not involved.  Its between the courts and the FCA.  Currently, the FCA has a consultation and the free-of-charge-to-use scheme with the lenders should be in place from May.

    Once you sign a contract, you are subject to their cancellation terms.     They have probably spent about 5-10 minutes on it as its little more than giving black horse your name and address and asking Black horse to look into it.

    So can they charge me a cancellation fee? 
    Yes.  Most contracts in many walks of life have cancellation charges if you cancel before the work is complete.

    I’ve received an email from car finance checker after filling out a form via Facebook not realising it was then saying I’d be going into a contract with them. The email is below. Do I wait for them to contact me? I’ve tried ringing to cancel but they said it hasn’t come through to them yet.
