LDK Group PCN

Hello all,

I'm in a hard position with a PCN and hoping for some help.

The PCN attached is from LDK Group.

Unfortunately I'm in the wrong. I was driving on a day I was experiencing hard events (partner split up with me, lost a job). And entered the private ANPR car park unthinkingly. There was clear signage everywhere as I entered the car park.

I got a contact for the landlord. The landlord asked if I was a client of the local businesses, all tenants in the building next to the car park. He was unsympathetic. He said that the tenant I was visiting on the day should email him about this and hung up.

I appealed and got the below response from LDK/ZZPS. Their appeal sneakily has a 'required' field where one has to state who the driver was, which I omitted.

Please could someone advise what I should do next? As always, help would be much appreciated..

Please note, you were provided instructions on how to appeal on the initial Charge and you are not advised to visit LDK website, this is why you were not able to locate an option to appeal there.

Please note, this case is compliant with the Protections of Freedoms act and as such you will be held liable as the keeper if no driver details are provided.

We have placed the account on a 7 day hold to allow time for the drivers details to be provided.

We note within your appeal you mention an overstay. For your reference, this does not relate to an overstay, this has been issued as you entered site with no authorisation.'

    Ignore the invoice. This isn't hard at all!

    Ignore DRA letters trying to 'extort from motorists' the £170 double recovery scam. 

    Still unsure that we are right about ignoring?

    Just click on the words underneath the little red 'MSE link' in the small 'Parking Ticket Appeals' banner at the top of this page which leads to the MSE Guide to fight PCNs.

    Same info is shown in both this forum and in that Guide, as regards the debt recovery letters being a futile stage and ignoring these demands being risk-free as long as you don't miss or ignore a Court Claim (easy to defend). Consistent advice here is not just from random strangers. The MSE Guide is official 'Martin Lewis backed' advice.

    See you if ever you get a Claim Form. Obviously you must tell LDK and their chosen greedy debt crawlers, if you move house.

    I read the guide but it advises not to ignore..? Am concerned about credit score being negatively affected..

    That said, I found a post from someone local on Facebook, who said they ignored their PCN and have not heard since.

    We put nobody's credit at risk here. We know what we are doing. Appeal is futile.

    But as I explained, we'll help you if ever you get a Claim Form. Obviously you must tell LDK and their chosen greedy debt crawlers, if you move house.

    I did get one… disheartening… Have you any thoughts of what I do now?

    I can try to contact the landlord again…

    You didn't get a claim form.

    My advice was to come back only with a Claim Form if ever they try. We do not want to see £170 threatograms ever again, thanks! Spare us.

    Did you miss seeing all the photos of these joke demands in the NEWBIES thread?

    Thank you, true it’s not a Claim form but if they’re sending this, and I ignore it, isn’t it likely I will get a Claim form? That’s my concern..

    Yes it's likely. If you were to reply to that letter what do you think you could say that will stop them from filing a Claim?

    Thanks for your reply. Then I can't ignore the letters. I am technically in the wrong but was driving after a bereavment which impeded my judgment.
