Double dip - Euro Car Parks

Hi all,

Euro Car Parks strikes again! 

A friend received a Notice to Keeper from ECP claiming that her vehicle was parked in a retail park between 14:12 and 8:12 the next morning. 

The vehicle actually made two distinct visits:

Firstly  between14:12 to 15:00
Secondly between 8:10 and 8.12

Two hours free parking is permitted for "customer only"

Friend has provided evidence to ECP that she was else where outside the true intervals, but was told by Euro "you might have been elsewhere but the vehicle might not".

Any advice for her would be great as she's a grandma and a little worried!

    Tell her it's nothing to worry about, it's a known failing of ANPR from a bunch of scammers out for profit, it isn't a fine it's just stupid company.
    7.3 of The Joint COP states quite clearly:
    Page 19 of 57
    NOTE 1: The manual quality control check for remote ANPR and CCTV systems is
    particularly important for detecting issues such as “double dipping”, where image camera
    systems might have failed to accurately record each instance when a vehicle enters and
    leaves controlled land, and for checking images that might have been taken other than by
    a trained parking attendant (see Clause 15). The manual check might also reveal where
    “tailgating” – vehicles passing a camera close together – is a problem, suggesting
    relocation of the camera might be necessary.

    ANPR will have captured  the first exit, Ask them for a time stamped picture of the first exit. If they cannot then clearly their ANPR is faulty

    Thank you Half_way. The ECP appeal rejection letter states "London Road, Maidstone", highly unspecific. Additionally the entrance/exit isn't actually on London road ,and London road Maidstone is a main road spanning some five miles or so.. 

    Not sure on the owner without a land search.

    Play hard ball and email back:

    "Your assertion is false. To save us all the faff of a SAR and going to Popla - which you will be charged for - instruct your DPO to provide the orphan images from the ANPR. This is a clear double dip case - cancel the charge and move on to the more gullible.

    If this goes as far as a DCB Legal court claim I'll obviously counterclaim as there would be serious GDPR repercussions from the unlawful retention of my data."

    Cheeky half wits are demanding a SAR to get the orphan images.

    Email them back and say there is no wrong door for a SAR and this email is it. And a SAR is free. The orphan images MUST be produced. It's a double dip case with illegal data processing.

  • Hi all,

    Well she's had the SAR back ,and no orphan images.  I know if she contacts the dpo at Ecp they'll claim they've satisfied the requirements of the act and can no longer assist.

    I guess it's down to Popla now unless any one else has a suggestion??

    This is the second double dip from the site she's had and the first one was cancelled.

    To make matters more complex she's revealed her self as the driver.

    Doesn't matter that she has admitted to driving.

    Only try POPLA if she can prove where she was in between. Google timeline enabled on her phone? She should do that now!
