Section 75 is unlikely to be relevant here - as with CRA not applying to B2B contracts, a similar limitation exists for the Consumer Credit Act, of which s75 is one section, although certain unincorporated businesses may be able to benefit from it. But even in a consumer environment, s75 only comes into play for a breach of contract or misrepresentation by the supplier, neither of which would appear to apply here…
