New Car warranty - Gearbox claim after 7 months

My daughter bought a new Nissan Juke (Auto) only 7 months ago which came with a 3 year warranty, three weeks ago she had a warning light (safe to drive but contact dealer) and she took the car to the same Nissan dealer she bought the car from, no fault found. Then 2 weeks ago after work around 8pm another warning came up Gearbox fault do not drive.

She waited for Nissan recovery (RAC partner) who had been told to take it to the dealer and collected her car and she was to go to the dealer in the morning which she did. The dealer did not know about the car until they contacted the RAC partner,  The car was parked outside the dealer with the keys left in the wheel area, not happy about this as the car could have been stolen.

It has now been 2 weeks since the dealer has had the car and she has just been told it needs a new gearbox which will have a 1 year parts warranty, they have found metal filings etc in the oil.

Does this gearbox also fall under the manufacturers 3 year warranty or will they say its only 1 year if other problems arise in the future

Could the metal filing have caused any other damage to other part of the car

A Gearbox should last for years, I know if it was under 6 months she could try getting a replacement vehicle, what her options please

A gearbox should last for years, unless its the CVT type fitted to Nissans which are a pile of junk if neglected.

 It needs regular fluid and filter changes to stand any chance of doing much more than 60,000 miles.

If the new gear box fails within the original car 3 year warrantee it should still be covered. If she intends to keep the car beyond 3 years she should take out extended warrantee on it.

A new vehicle then the manufacturers warranty should cover it for the Three Years warranty that the car comes with. DO NOT fall for the 12 month thing.

If you'd paid them to fit that gearbox to a car that wasn't under warranty, the gearbox would have a 12mo warranty.

Since it's a warranty replacement for the car, it is covered by the balance of the original warranty - there's no extra or additional warranty on the box alone.

I think the only exception to what been said above is if the car was 2 year 6months old you would have the balance of the 12month warranty I.e 6 months.

If you have a warranty repair that you don't pay for, the repaired part is warranted/guaranteed for the remainder of the vehicle warranty (subject to the terms of the warranty- like audio equipment is only covered for the first 12 months of the 3 years)

In this case if the whole car including gearbox would have a 3 year warranty from registration, the replacement gearbox under warranty is still covered for (2 years 5 months) the rest of the 3 year warranty.

(If it was done after 2 years 11 months then the new gearbox would only have 1 month's warranty)

If you pay for a replacement then the replacement is covered by it's own separate warranty, usually 12 months from fitting. 

If you buy a cheap TV with 12 months warranty, and it blows up after 11 months, so you get a new replacement under warranty/guarantee, the replacement is only warranted  for a month- you only get the original 12 months warranty that you paid for (you can't get free TVs for life by having the good fortune to blow them up every 11 months)

Unrelated, but of slight interest, 

I got a "free" TV by applying to a manufacturer offer when I bought a projector. (proof of purchase etc.)

I assume that it has no guarantee at all, as I paid nothing for it, and I would only need to be refunded what I paid- i.e. zero!

Yootoober car traders are now raffling the cars that they don't want to punt on and have bounce back. You can win a running car for £1. The advantage for them is that if it blows up in the first 10 miles, they can simply give you a full refund of what you paid- £1! and arrange for a scrap dealer to collect it from your house.

As long as they sell enough tickets to cover the cost of the car they are winning. (There is a clause in the T&Cs that says if they don't then you win 50% of the ticket take or similar)

This is true even if you make a contribution. I had an engine replaced towards the end of the warranty - by making a £10 contribution myself it triggered a 12 month warranty on the engine.

You cannot have Warranty on Warranty. The manufacturer sets the period at the start and during the set period he will repair or (at his discretion) renew - The warranty on the repair lasts as long as the original and finishes at the same time BUT should you be asked to contribute to the cost then the new part has the full warranty of the part. If in this case the vehicle warranty expired a month after the repair then that is it but because of the contribution it enjoys the full warranty as though you had bought it but possibly only paid 10% of the cost. If you fit it yourself then only the part enjoys the warranty but if fitted by thr repairing garage it also covers the labour cost of the repair.

I was a Ford Warranty Manager for 15 years and had many such cases.

It is a seven month old car with a 36 month manufacturers warranty.

I was pointing out the difference - I had cases where engines were replaced during the warranty period but were not covered by warranty. In one particular instance several vehicles had new engines due to raised manholes taking off the sumps - They all had new engines but it was a problem sorting out warranty issues on some of them.

In the Ops case I am puzzled why they are being told about reduced warranty - If the repair is being done under warranty then it has the balance of 29 months warranty. -

Unless there is something we are not being told.
