My understanding is the same as Newcad's.
Tribunal is seeking to re-determine the decision appealed against and that decision will apply from the date of that decision appealed against.
DWP Review will impose a new decision which will then take effect (although again expect delays in that regard).

And bear in mind DWP can review a claim at any time.

It's unfortunate these complicated situations are arising due to delays in challenging decisions.

Im having difficulty understanding. If tribunal extend the length of the award. Will review still go ahead?

    I would think so...

    Did you challenge award length?

Yes I put in the appeal to challenge the award length. Also in the submission.

Unfortunately even if the tribunal did extend the previous award length it would make no difference.

The DWP can start a reassessment at any time that they deem a reassessment is necessary.

Look at things the other way-
IF the tribunal don't find in your favour then you have a new assessment decision to MR and appeal- and who knows the new decision may be what you are looking for anyway?

    Hello nice people.

I would like to update on my tribunal which took place this morning. From going Into the hearing room and then waiting outside while the hearing was adjourned. I was there for approximate 30 minutes until a decision was made.

New decision low care 11 points to high care 13 points

New decision No mobility to planning and following journey 4 points mobility 10 points 14 points high mobility

Pip award to be extended for 1 year

I contested four descriptors but the tribunal only focused on 1 descriptor and said we can award you points for the descriptor which takes you to 13 points this reaches the highest award available so we do not need to look at any of the other descriptors. The panel were very kind and understanding. A DWP representative was also present he did not say much but he agreed with the panel.

I was so shocked at the time the awarded me I totally forgot to ask that I have had text about review of award has started.

So after being so anxious I have finally had a positive outcome.

    Thank you so much.
