Sick leave over Xmas

    I am struggling to understand from the thread whether this is considering some hypothetical situation or a real circumstances.  If the latter, is the OP posting as the employer / line manager, the employee who is unwell, or a colleague of the unwell employee?

    As this situation means a sickness absence of more than 7 calendar days, they would have to get a Fit Note from their GP.  The OP doesn't say how long the person will have been off sick prior to Christmas either.

    Someone booking holiday then wanting it back because they were ill during that time might be covered by the stupid ruling, but I do not know anyone who thinks it is right, nor do I know any employer who looks upon an employee taking that course of action as good for their career. I say that as someone who gives all my employees 43 days holiday a year, plus an Christmas office closure on top (depending on the year, so this year five days), so I recognise employees need a break.
    Well, I did it, the year DH and I ended up on a drip in the local clinic on the second day of our holiday. It was not a relaxing holiday.

    But I did think to email manager once back at our hotel. 

    Returning with evidence and no prior contact could have led to a 'no', because following your employer's normal method for notification of sickness remains, whether you're there or away. 

    In my case, normally a phone call on the first day, or as soon as practicable.

    It did not harm my 'career'. But I was known as a hard worker.

    I'd first learnt it was a possibility in a previous job, when one of my team claimed. That didn't particularly hurt their career trajectory either, because they were already known not to be fully committed.
