    You are complaining. Big difference. There is an entire thread dedicated to Successful Complaints About PPCs. Did you miss it? First hyperlink in the NEWBIES thread first post.

    But surely today you found out by Googling, who runs the site? Most new posters here find that in minutes when there is a named retail park to search t'internet for. All you are looking for is the property management firm at the site.

    Gr1pr states not to bother appealing to the IAS. Would this not go against me if it goes to court, having not exhausted all avenues first?

    OK so I have obtained the information of the owners from the land registry. Not sure if I am legally allowed to say who they are on here but they have leased the land to Excel Parking Services Ltd on a 6 year lease from 07.09.2022 Term : 6 years commencing on 25.12.2022 ending on and including 24.12.2028

    I presume I still complain to the original land owner as appealing to Excel (the leesee) would be essentially p***ing in the wind?

    If allowed, would it help others to share this information I have obtained?

    Hi Coupon Mad, I did read everything in the newbie thread and more. There was so much to take in and I don't have the greatest of memories. I couldn't initially find any retail park associated with the car park and the post code was confusing as some say the land is WF1 1ED when actually it is WF1 1EL.
    What makes it confusing is that the car park is called Smyth Street car park. Smyth street has a postcode of WF1 1ED yet under the land registry information it is not the same. It is down as 'Land to the South of Westgate WF1 1EL' Would have made more sense to call it Westgate car park

    Absolutely DO NOT believe the useless answers you will get on CAG.

    If Excel lease the land, then they are lawful occupiers with title (legal interest) in the land, so forget the idea of landowner complaint.

    Should I be appealing to the IAS?
    No. They do not consider mitigating circumstances or the Equality Act 2010.

    You have told Excel about your protected Equality Act needs and they rejected it out of hand. Just ignore them, safe in the knowledge they are discriminating against you and that any judge would apply the Equality Act. 

    Ignore the tedious letter demands that you can see in pictures in post 4 of the NEWBIES thread.

    Still unsure that we are right?

    Just click on the words underneath the little red 'MSE link' in the small 'Parking Ticket Appeals' banner at the top of this page which leads to the MSE Guide to private PCNs.

    Consistent advice here is easy to find and not just from random strangers. The MSE Guide is official 'Martin Lewis backed' advice. Same info is shown in both this forum and in the MSE Guide, as regards the debt recovery letters being a futile stage.

    Ignoring the demands is risk-free as long as you don't miss or ignore a Court Claim (easy to defend). Obviously tell them if you move house because you can't miss a Claim Form.

    Come back if you get that. Do NOT post pics of £170 threatograms; thank you for not showing us those in 2026! No thanks. Just ignore those. And come away from CAG.

    This is all new to me and I appreciate any help from anyone.
    I will of course forget about CAG as you say. It was vain attempt to try and find the landowners before I got the information from the land registry.
    So as it goes so far.
    Don't bother complaining to the land owner as they have leased it to Excel.
    Don't bother with ISA.
    Ignore the first rejection letter from VCS Ltd saying I can appeal to IAS.
    Ignore any other letters from Excel or VCS Ltd which I assume I will get more of after the 28 day appeal to IAS has passed.
    No need to post letters of potential future threats

    DON'T ignore the Court Claim !

    I have read other people's issues with Excel/VCS Ltd saying the court could be in Northampton miles away from my address, but this can be changed. Can a more local court be requested on the Court Claim I may receive?

    Good summation. The Northampton ‘Court’ is just an admin centre that distributes claims. If Excel do proceed to litigation, the Court hearing will be held at the nearest one to you. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Coupon Mad, I read MSE Guide to private PCNs again just to make sure it sinks in a bit more.
    I have already made the huge mistake of admitting being the driver, am I basically stuffed now then or do I simply carry on as above and wait for the Court Claim ?...
    Siting things like the Equality Act 2010 and the fact that the lease contract is between the landowners and Excel Services Ltd while the threats for payment are coming from VCS Ltd who are a separate company?
    Just want to prepare myself for a possible Court Claim.
  • Dont Over think just deal with any court claim when it comes.
