POPLA Appeal Refused

I wondered if anyone could help. I recently appealed a PCN with POPLA and its been refused so now saying I owe £100. This happened because I entered a car park on a Sunday evening (after the retail store was closed) to handover my child to her father for the week (I won’t go into reasons why this was done in a public space) and hadn’t realised there were parking restrictions in place for out of hours. I was there for a total of 10 minutes and appealed as felt this was disproportionate to the timing and the fact I was not using the car park to go off elsewhere to shop. I also felt this was not enough time for me to consider the parking restrictions and ‘read the signs to make a decision’ 

The positioning of the entrance to the car park is off a busy main road and therefore no where to safely turn and leave without actually entering it. I have made the mistake of not researching enough before appealling and therefore unsure on what to do next as I believe next steps is court. I am confused by all the different terminology that gets sent through the appeals process so looking for advice from someone who may have had a similar experience and can advise next steps. The company issuing the PCN is Parking Eye.

    Its all laid out,  so in simple terms 

    Ignore the powerless debt collectors letters,  or begging letters 

    Wait for the Letter of Claim giving you 30 days notice,  by post, and respond,  as per the newbies sticky thread in announcements , by email 

    Then await the Money Claim pack from the CNBC in Northampton using MCOL by post,  within the next 6 years 

    After that arrives there are numerous steps and deadlines to meet,  as seen in thousands of other threads and cases on here

    Yes, sounds like your appeal to Popla wasn't based on anything to do with contract law and was just a common sense plea. But common sense doesn't apply to scammers. 

    Doesn't matter though. Popla is not binding on you and you can safely just ignore them.

    Same with the debt collection letters.

    Come back if you receive a letter (likely from DCB Legal) headed 'Letter Before Claim'.

    Of course. This is nothing new.

    Ignore DRAs.

    Just click on the words underneath the little red 'MSE link' in the small 'Parking Ticket Appeals' banner at the top of this page which leads to the MSE Guide to fight PCNs.

    Same info is shown in both this forum and in that Guide, as regards the debt recovery letters being a futile stage and ignoring these demands being risk-free as long as you don't miss or ignore a Court Claim (easy to defend).

    Consistent advice here is easy to find and not just from random strangers. The MSE Guide is official 'Martin Lewis backed' advice.

  • Thank you for this and really appreciate the advice. Will come back with an update. Def scare mongering tactics used by them when you see debt collector letters coming through.
