That method just maximises the amount of time available. But yes, you can simply file a defence immediately.I was actually not the driver of the car at the time, I was overseas. I do know who the driver was but wont be inclined to disclose the details.
They are claiming you are liable under the Protection of Freedoms Act, which is fine. You don't have to name the driver and can "take liability."
But it's all pretty moot as they will discontinue in a few months anyway as they just use the court system as a cheap £35 debt collection facility rather than intending to take it all the way to a hearing and a judge. Should be made illegal, but the Ministry of Justice likes being handed a lot of thirty five quids.
