Horizon Parking - Tesco

Hi.  The registered keeper has received a PCN from Horizon regarding an overstay at a Tesco Extra.  The store in question has been used by the registered keeper for as long as anyone can remember and was always 3 hour maximum. At some point the time limits have changed.  Within the paperwork received and the photographs online, the tariffs are not provided as evidence.  After some Googling it appears if customers are there between the hours of 10pm-midnight the limit is one hour.  Between midnight and 6am it's 15 minutes. Why anyone would park there at any point after midnight is beyond me, unless you were there prior to the store closing.  From what I understand from various forums is that Tesco have no desire to get involved and defer back to the parking company.  If for example the driver arrived at 23:30, on their way home from a late shift at work, bought some items, ate the meal deal purchased in the car before exiting at 00:40, thus crossing over two tariff bands, but exceeding the overall stay regardless, is there any way this can be fought?  The store closes at midnight, it was mid week, definitely no loss to the landowner?  Just wondering if anyone has any thoughts on how to approach?

    Not much you can do, but these cases tend to end up with Gladstones making a court claim and then discontinuing. Can't find one that's gone to a hearing. Plenty of cases of people asking for help and then vanishing months later. People have a habit of getting a discontinuation and then not bothering to go back to update their thread.

    Certainly never seen one of Tesco's stupid three different time restrictions go in front of a judge. No different than a trolley's wheel's locking up in the middle of your shop and a bill for £100 being ejected from the handle because you didn't finish fast enough. 

    Literally a very expensive game of Supermarket Sweep.

    Almost makes me want to get a core claim so I can put that in the defence!
  • Our local Tesco implemented something very similar a while ago.
    I understand it was introduced because of young drivers using the car parks for meet ups and were causing a nuisance.
    It does seem weird that in one hand Tesco wants people to visit the store by opening 24 hours which is great for shift workers and also people who do not like crowded spaces. Then in the other hand they limit to 15 minutes with no way of extending for real shoppers.
    Tesco should allow you to use evidence of receipts to show that you were shopping to allow parking for longer.

    My only suggestion - If you was shopping and used clubcard you can get a copy of the receipt and write to Tesco to see if they will help.

    But the bottom line is, you don't PAY!

    I mean we haven't even asked yet:

    - what happened with Plan A?

    - is the NTK POFA worded or not? Please don't show it (the whole point of my NTK pictures thread is to stop posters asking us to tell them if a NTK is a POFA version or not).

    Plan A, was as expected.

    "I'm sorry to hear you have received a parking charge.  Please follow the appeals process, as we can not waiver any charges until there has been a decision by Horizon.  If this appeal is rejected by Horizon please get back in touch and we can look into waiving it for you"
  • I've compared the notices you have put up.  Mine refers to POFA, but isn't the same as the examples. I have asked Mad_Ferret72 to post their letter to see if they are the same.  If they are then presumably my technicalities would be the same as theirs? 

    The photographs show entrance and exit, not a parked car.
    The issue date and the assumption the keeper received it 2 days later.

    You are advised that if, after the period of 28 days beginning with the day after that on which the notice is given (which is presumed to be the second working day after the Date of Issue), the amount due has not been paid in full and we do not know both the name and current address of the driver, we have the right to recover any unpaid part of the notice from you.  This notice is given to you under Paragraph 9(2)(f) of Schedule 4 of the Protection of Freedoms Act 2012 and is subject to our complying with the applicable conditions under Schedule 4 of that Act.


    I suppose I'm confused about them stating POFA, but not understanding whether they are actually compliant? I'm sorry.  This is like Josh Gad teaching Vince Vaughan how to code in The Internship  :#

    (If so, the green signs probably merely state "staying over 2 hours?" (and then some unreadable tiny font). There will be almost as many green YPS signs as there are blue Tesco/Horizon signs and plenty of parking locations where only the green signs are visible)
