    I suggest that you start a new thread of your own, with suitable information and pictures regarding your case

    This group thread is mainly for Smart Parking DCB Legal cases, not NE Parking

    As a Newbie you cannot edit posts until your status changes to Forumite

    You should still open your own thread because the 2 companies are not the same and your case will end up buried in this group thread, ideally this thread is to hone a suitable defence to identical Smart Parking cases, not yours. ) its also only about the initial defence, not the numerous later bespoke stages

  • Going through this exact process now, Claim is an eye watering £512.76 for two tickets, one being only 11 minutes overstay with a busy junction exits (4 way traffic lights which regularly take an age to change and likely trap a lot of people!) the other was 44 mins overstay at a free parking site. Surely they can only charge for a ticket +, the law is crazy on parking tickets!

    Used the latest version of the Melton/Coupon-mad defence, hopefully DCB Legal Ltd and Smart Parking will abandon it!!

    On an other note, I never received a Parking notice/ticket, it went straight to the debt letters, of which I have a massive pile of them, bordering on harassment!

    There Is no actual law on PCN's, its currently an unregulated industry , some laws regarding contracts and consumer laws play their part, but regulations should arrive next year

    As for missing PCN's, the usual cause is not updating your V5c promptly, after moving. The PCN's go to the address registered with the dvla, even if its the South Pole ( even if its out of date, that scenario is down to the RK , so usually the fault of the RK. )

    DCB LEGAL cases are discontinued before the hearing fee is due , if properly defended

    The username was meltof, the post dated 12th April, use that defence, unchanged

    Regarding DCBL taking me to court for an unpaid parking charge sent to my previous address, I submitted my defense on MCOL about 3 weeks ago. I received a letter from the court acknowledging my defense and stating that the claimant, DCBL, may contact me to try to resolve the matter. DCBL has been trying to reach me by phone for the past 3 days. Do I need to pick up the call? Is this the compulsory resolution call?

    Its not DCBL either, it's DCB LEGAL

    Is this the compulsory resolution call?

    Nope. That call will involve DCB Legal (on behalf of Smart Parking), but it won’t be driven by them. The court will contact you about it in due course.

    Hi all!

    Hopefully posting in the right place.

    Had a charge for £100 from Smart Parking for driving onto their car park, getting stuck there for 10 minutes trying to get OUT of the car park because it was jam packed, not parking at all, and finally leaving.

    In my naivety I sent an appeal which was ovbiously rejected - they state their parking signs 'clearly state' that all motorists must pay for *time on site* (they don't - the signs are not clear, not viewble safely while driving past navigating traffic and pedestrians, and say motorists must pay for *parking*, but obviously all of that is irrelevant, they're just bullies who want their £100).

    We've had the letter back that the appeal was rejected, we can either pay or appeal through IAS.

    That's when I found this forum.

    Just wanted to make sure that the steps now are to do absolutely nothing and ignore them and their debt collectors entirely until IF we get a court claim form?
