TfL Box Junction penalty

Advising someone on this matter: He crossed a box junction and stopped - literally (correct use of the word) - for no more than two seconds. The penalty is £160 reduced to £80 if paid within 14 days. Is this worth contesting?

  • So they entered a yellow box junction when their exit wasnt clear and they weren't turning right and as a consequence had to stop in the yellow box junction contrary to rule 174 of the Highway Code and TSRGD regs 10(1) & 29(2)?

You've not given any mitigating circumstances and the rules are fairly clear cut. Guessing they gambled the traffic would clear rather than actually being clear and they guessed wrong.

I should have added  - yes, he was turning right.

He was turning right. Entered the box junction to do so, momentarily stopped, then continued on his way. At no point did he block the junction.

Turning immediately right and only stopping due to oncoming traffic (then completing the right turn) is a winning appeal.

As long as the right turn was IN the juntion.

Thanks. That is the case. I'm suggesting strongly that he appeals. One lingering worry is that if he does appeal, and loses, he won't get the discounted payment option - £80 as opposed to £160.

But that is the dilemma and the gamble in any of these cases

But everybody knows you can stop in a box junction to turn right. It's pretty difficult not to.

Are you sure? Is there a video to view? Because it would be alarming if the council were issuing such penalties.

Generally they hold the discounted rate if an appeal is unsuccessful because they don't want you going to the Tribunal.

If it is as you describe then he can't lose.
