I don't think it's getting settled. Their email said the client instructed them to gi ahead with the hearing if I don't agree to the £250.
Can I just confirm, if I am going for the hearing this Thursday,- I have my witness statement, my skeleton argument, all my evidence... Do I need to prepare anything else like an opening statement? How does the hearing go? Is there anything else I should know/remember?0 -

Entirely depends on the judge. Almost always the Claimant will go with an opening statement first though. Sometimes it's more of a discussion, sometimes it's more formal and sometimes the defendant doesn't get to say much at all if the judge is minded to dismiss it early doors.Kid.Kadoo said:I don't think it's getting settled. If you lose they won't be having a party, you'll just a line on a spreadsheet for them.2 -
Their claim (and hence, my counter claim) was dismissed! I was awarded my travel costs from the day, and the maximum cost cap available for the day for my time.
The judge was lovely and basically blasted UKCPM for terrible evidence/admin/practice and threw the case out on a sort of technicality I suppose! She said she noted a theme of poor work(admin/paperwork .. can't remember exact words) for all the claims UKCPM bring to court.
I'm sort of disappointed the whole thing didn't get heard in it's entirety, to know if I truly had things right or not, but I still take it as a win. I'm proud I held my nerve all the way to the end and didn't settle with them. I would've had slightly more money out of them, but the satisfaction of having them dismissed by judge properly was worth much more to me!! I think I would've regretted it morally, otherwise.
