Car finance claim - PROBLEM SOLICITORS???

I made a claim for mis-sold finance from the same company that was later investigated by the FCA who stopped them being able to take on new clients.  Now it is at the point where I am being contacted by their in-house solicitors to start the claim.

The FCA mentioned that the claims company had been guilty of 'misleading advertising, aggressive marketing, and hiding fees. '

I am reading the small print of the solicitors. it says they implement a 'conditional fee agreement' wherever possible. The agreement had always been that they would take their 30% share of any payments made to me and I was and am happy with that.

My worry is that they may actually charge me, for making this claim and that it may not be a strictly no win no fee situation.

The small print talks of 'certain disbursements' and scenarios based on if I lost the case. (i.e. if they lost the case!) ..they mention 'specialized legal protection insurance' would cover this and I would provide this via my home insurance policy and none of this was mentioned before.

Has anyone experience of these issues in the process of their claim?

There are a couple of issues with what you have said.  The FCA does not regulate solicitors and cannot stop solicitors from taking on new clients.   The FCA only regulates claims companies that are not regulated by the Law Society (i.e. not solicitors).

The agreement had always been that they would take their 30% share of any payments made to me and I was and am happy with that.
You were happy to pay 30% (plus 20% VAT) for something that is free of charge?

Has anyone experience of these issues in the process of their claim?
The vast majority of people are not silly enough to use ambulance chasers.     However, unless you name the company, nobody will know what the contract is that you have.
