    But why is it listed in that order? Looks like your AOS was processed first...?

    Hang about. I've queried the order of entries there. An AOS done online is immediate.

    There is a difference between submitted and received in relation to MCOL
    And not Quite a document is submitted,  then it takes to time be " received "
  • Is it worth submitting my defence still? A little confused as how to proceed.

    No you can longer do that, ive advised who to email as to negotiating the amount paid , offer £60

    This is the relevant part of the CPR - However i believe filed may be classed as received and not submitted, it any case it would require a set aside application so its quite mute

    12.3

    (1) The claimant may obtain judgment in default of an acknowledgment of service only if at the date on which judgment is entered—

    (a)t he defendant has not filed an acknowledgment of service or a defence to the claim (or any part of the claim); and

    (b) the relevant time for doing so has expired.

    (2) Judgment in default of defence (or any document intended to be a defence) may be obtained only—

    (a) where an acknowledgement of service has been filed but, at the date on which judgment is entered, a defence has not been filed;

    (b) in a counterclaim made under rule 20.4, where at the date on which judgment is entered a defence has not been filed,

    and, in either case, the relevant time limit for doing so has expired.

    (Rule 20.4 makes general provision for a defendant’s counterclaim against a claimant, and rule 20.4(3) provides that Part 10 (acknowledgement of service) does not apply to a counterclaim made under that rule.)

  • I’ve emailed them to offer the settlement amount. Will let you know once I’ve received a response. Thanks
