Over 35 days since appeal to PPC

Hi all,


I received an ANPR PCN from Britannia Parking. There was no windscreen ticket.

The Notice to Keeper arrived on Day 16 after the parking event.


Following the guidance in the NEWBIES thread, I submitted an appeal as the keeper.

Appeal submitted: 26/09/2025

Britannia response (not a rejection, no POPLA code): 17/10/2025

– They asked for more information / driver details but did not decide the appeal.

My reply (declined to name driver + requested POPLA code or cancellation): 23/10/2025

Britannia issued POPLA code: 13/11/2025


This POPLA code was issued 48 days after my original appeal.


My question:

From my understanding “Under the BPA Code of Practice (v9), operators must accept or reject an appeal and issue a POPLA verification code within 35 days of receiving the appeal.

If they fail to do so, the appeal is deemed accepted and the PCN must be cancelled.”

So, does the fact that Britannia took 48 days mean they are out of time and that I can argue that the PCN should be cancelled due to a breach of the 35-day rule?

I would be grateful if someone could provide a template of how to respond.

    No.
    Hi @Coupon-mad, I’d be grateful for some further clarification if possible please? 

    My understanding is that they are a member of the BPA and have exceeded the Code set out by the BPA? 

    Is my next step to carry out the POPLA appeal?

    Yes they’ve rejected the appeal and provided a POPLA code 48 days after my submitting my original appeal to them

    They haven't breached it because they are allowed to ask for further info, and they did.

    Thank you for the explanation. 

    I'll begin drafting my POPLA appeal. Ive seen quite a good one that I will try and replicate by user MikeHammer here:

    Out of curiosity, my main argument will be the keeper liability, would this scenario fall under it? 

    The day of the parking incident was 06/09/2025 the notice on the letter was dated 12/09/2025, and the letter was delivered on 22/09/2025. Therefore I did not receive the notice within 14 days. 

    Would this be a strong case for the PoFA 14 day rule? Many of the examples I've seen on the forum, the notice on the letter is 14 days after the incident which is obviously a 'slam dunk'.

    The NTK PCN was presumed to be delivered 2 business days after the issue date,  so if they sent it 6 days after the incident date they rightfully presumed that it would be delivered by day 14, 8 days later

    So IMHO you have no legs in delivery arguments , due to the Court of Appeal ruling 4 years ago

    Thanks for the explanation Gr1pr, seems like a bit of flaw that they can get away with something like that. 

    Seems like I'd have a slim chance of a win a POPLA then, the strongest argument would be their poor signage which only faces one direction along the road.

    If the postal system is failing and the Royal Mail are fined 21 million,  then it's not a failing of the private parking company,  or anyone posting letters, it's a Royal Mail issue or breach of the service contract 

    You should focus on refuting the allegation,  but seem to be looking for an easy get out in a currently unregulated industry 

    No landowner authority and signage issues are what tend to win at popla,  assuming that you appeal to popla

    I'll still appeal to POPLA, I just genuinely thought I had a case for the 14 day NTK.

    Thanks for the help, I'll focus in on signage and land owner authority for my appeal. I can see there's a whole thread for this topic in the newbies thread.
